I took out a pay day loan trough a walk in company. This was back in August of 04. I paid 75 every two weeks till Dec.04. Now I realize this debt is long over due and I've only gotten it down from 500 to 330. I just kept forgetting about it. I got a phone call Legal Mediation Practice yesterday. Telling me I had till 6pm to pay off the 330. Or they would take legal action against me. I asked till Monday and he told me no he's not a debt collector. I called back and spoke to someone else. Saying I could at least pay 100 to 200 on it yesterday. She told me they aren't allowed to accept partial payments. So I then asked her what you wouldn't take my money. She said it would applied to the balance. But they would still move forward. So I asked what are they going to do put out a warrant for my arrest. She said it's worse than that they will get you on check fraud. So I'm kinda freaking out today. I have a money order that I'm going to send certified mail to the actual loan place today. When I called Legal Mediation today I asked are you a collection ageacy or a law firm. The guy said we have a law firm upstairs and downstairs. I told him I looked him up on the BBC and it said that they are a collection agency. Then he proceed to ask my name. So are they going to throw me in jail today??? This company Website doesn't look at all like a law firm.


Let me tell you they cannot put you into jail for not paying your loan back. If your creditor files suit against you, it goes with civil court, so no one will come to arrest you, relax.

They are listed as Collection Agency with BBB. So they fall under fdcpa rules, right? Send them debt validation letter and ask them not to call you any more. Mention that all communications should be through mails.

Contact your lender and inquire if they can accept payment or not. Mention the amount that you can afford. Keep documents of all your payments. Keep us posted.

JJ, if the account is under collection, sending MO to the lender will work? Will they accept it and collection calls will be stopped? Need your opinion.

Who you are going to pay the collection agency/law firm or the original creditor? You haven't received any response from them, so paying them could be risky. You should see some written documents before sending your payment.

They cannot bring charges like check fraud against you. Post dated checks are not considered as bad check.

or, if you already have the money orders, leave the "Pay " blank. Contact the OC and state you want to pay them only (if its a store front, I would go in and talk to them, its harder for them to feed you a line of crap when hey are staring you in the eyes...)If the OC accept the payment, then demand a receipt stating the account is paid. If they refuse to accept the payment and call the account back from collections, then hang on to the MO's. State you will pay them in that manner only ( I am assuming here you have the money to pay this off now, as that kinda what your post sounded like, if so this is a great opportunity to screw with the CA). If they refuse to accept that payment(s), then hold off till they send it to a different CA or take you to court. Make the offer to pay in witting, CMRR (do document your efforts to pay and their failure to respond or refusal).

If they try to take you to court MAKE SURE YOU GO TO THE COURT DATE,take the MO's with you and when its your turn to speak, tell the judge (and have your documentation ready) that you have been trying to pay,but they have refused to accept your payment, and chose to waste the courts time instead (maybe in not so many words, but you get my point). If these clown are just starting out, why not get them off ont the right foot with the judicial system?

I just got a call from them too on today the lady was very agressive I used to work for a collection agency so she did'nt scare me
I laughed at her and at the end of the conversation I gave her the fdcpa miranda rights she did'nt like that at all dont let those peopl scare you that's what they want to do. Scare you into making the whole payment when they want you to not when you are comfortable and can do it without strugling
