Can this be right? What do I do? I was overseas in Japan from 1994 to 2002. I then moved to FL. I recently moved to VA for another job so this was the first full year I filed VA taxes again (I was in VA prior to moving to Japan).

When I filed this year, I was due a $196 refund. Instead I got a letter saying they took that and that I owed another $500+ amount. What the ???? They said it was from 1992 or 1995 (I can't find the letter right now... in the process of moving in one week). If it was '92, wouldn't that have come up in my 93 or 94 tax return? If it was 95, I was overseas and not expected to pay VA taxes.

How do I deal with this government debt? They didn't take any of my federal return and I don't believe I owe it... esp. not that much. Back then, I made less than 30K a year!


The first thing I would do is call the VA tax people and inquire politely(Only way you can deal with tax people) and see what they have to say. Even if you owed a small amount the penalities from that time could have easly added up to the point of the money you stated. Talk with them first see what they have to say then explain your side and see how they explain it.

I just got through dealing with a KY tax issue after I had moved to IN and I thought I was an Indiana resident that first year but appearantly was not and still owed KY. Well just sent them their last 600.00 to pay that off last week ( total was around 1500.00 and half that was interest and penalities) Hate to say it but thier is some truth in you can't fight taxes. They had me set up on a $50.00 a month payment which wasn't to bad. Just glad I was able to knock the rest of it out last week in a final sum.

Thanks Tim. I wish I had stayed overseas sometimes! A tax debt from 10 years ago? Geesh. I would have figured they would have taken it out of one of my many federal refunds or wages prior to now. This is the first I heard of this debt. I am very annoyed to say the least. I don't trust verbal agreements since I have been done wrong via those in the past. I think I will send them a letter requesting an explanation and explain where I've been for the last decade. Certainly can't hurt the situation.

If you call them and talk with them and see what all the information pertains too you would then also request that any agreement you would come to be sent to you in writing before sending any information or payment.

The one good thing about going ahead and calling to make first contact it does show that you are wanting to cooperate and I have not seen it as an unreasonable request to recieve things in writing when dealing with the state tax people(though my dealing have been strictly with KY)

I cant say I recallever seeing the state being able to put a claim on a federal return(though I have seen the federal snatch a state refund fast enough)State may not be to take from federal though I am just voicing a guess here.

I have always found that starting off your coversation with "I have a problem, and I am hoping you can help me...." Tends to get good results, especially when dealing with the government.

I am sure they get alot of irate callers and they are willing to go out of their way to help the really nice callers.

you're right Ocean, it seems like they would have caught this before now---but unfortunately the IRS does things like this. its not unusual for them to come back years later and say you owe them. I've heard of this several times before--funny though, I've never heard of them sending anyone money years later because 'they' made a mistake. Its always about you oweing them, that's usually how it works.

Welcome to the great commonweatlth of Va.The penalties and interest are quite large here,and it just keeps getting higher until you pay.They cant take it away from your federal tax unless they submit it to the TOP (tax offet program).In 2002 I forgot to file because I had a fire at my house and was out of my house for 3 months (DEC,Jan,Feb)I would have gotten a refund of $143,but I didnt file,well guess what?In 2005 I received a letter stating that I owed $441 in tax and penalties.Its hard to fight the government,but I will never forget to file again.If you moved out of the country,unless youre in the military,they would not be able to do any thing unitl you came back,and It does take a few years,its may be away of getting more money from us,who knows.

Thanks everyone. I am not sure what's going on with these state taxes, but I am going to call them (and be nice... unless they get nasty with me).

I wasn't "in" the military the last time I went overseas, but I was married to it at the time.

I'm sure I'm not gonna like the load of cr*p they tell me. They better get what they can now tho... cause the first good opportunity that is out of state that comes my way... I'm outta here. This area is @#$! Fortunately, I love where I work so that makes it a lot more bearable.
