Hi David!!! Heres what you should do. Send them out a validation letter ASAP. so they can show you proof of why they're saying its yours. send the letter certified return receipt and hang on to it for your records. Also add in a cease and desist, if you don't want them calling your home. Tell them to do not call but written correspondence ONLY.

Hi David, I got your PM and wanted to get back to you. since it is from the Law Office Of Mitchell N. Kay, you will need to send the validation request letter to them. I received something in the mail from them as well---asked them for validation--never got an answer and the debt never went on my credit report since they couldn't validate--this is why its important for you to go ahead and do this. Anyways, they have a reputation of not being on the up and up--and thats putting it mildly. They buy alot of OLD debts that are out of SOL and junk debts. so probably when you ask them for validation, you won't hear from them again. I haven't. hope this has helped.

If I am not wrong this account is going behind you from the original creditor. Are you sure someone else did not open the account with your info? In that case you have to be more careful and take up the ID theft precautionary steps.

And if the account is appearing in your credit report, you can dispute it with credit bureaus also. Keep us posted.
