fine

XpressCash is apart of Whistler Holdings. Have you had any recent phone conversations with Shelby before? Shelby, sounds like the attorney for Shelby Taylor James & Associates, did you manage to get a return contact number for Shelby?

There were no actual threats made, since no words of arrest came out, so at this point your only complaint can be for harassment since you told them to stop calling. See if you can find out more information about the company calling you. If it's an outside collection company, a law firm, or if it's XpressCash aka Whistler Holdings themself. This will better enable you to lodge your complaints and help get the matter resolved.

By the way, have you contacted your counselor at T&C about the recent phone conversations?

Regards-
Mike

Mishele

After receiving another call from him, ask for his companies name and phone number/contact information. Immediately after, explain that the call is being recorded and that you have asked several times for him to stop calling. Hang Up!

Hopefully the calls will come to a stop. If you have caller ID service, don't answer any unknown/private calls. My practice is to hang up right away so it disconnects right away.

In the meantime, if such information was provided, private message the information to me, and I will see if he's tied to a law office.

Mike

Mishele, As I just mentioned in the pm i sent you, not olny is it time to validate this, but to put them on notice that you haev caught on to their misrepresentation of who they were, don call me only in writing type of validation.. basically tell htem what they can;t do so that when they ignore it, you have more proof to add to your complaints

ipay...The fact of the matter is that they OVERCHARGE over what is allowed by Ohio law. Most of us in this situation were unaware of these laws until presently. No one is arguing that they are owed their money--But only the money they are legally entitled to.

And one personal question..If you pay your bills, why are you here?

i pay
some of us have paid our original loan, PLUS the interest many times over. I don't think any of us are trying to get out of paying what we rightfully owe..what we do object to is the illegal practices and threats that these companies use to get more money than they are owed! some payday loan companies are "honorable" One click cash is the nicest...but others, like cash today Ltd, sonic and others are extortionists at best.

we all have been in trouble at one point and we come here to give each other strength and wisdom to help each other get back on out collective feet.

ipay 1) Provide a specific exam;ple as to how either mikey or myself have told anyone to violate any laws, 2) I do have a job and a very good one at that, which allows me freedon to manage my time as I wish, 3) yes I do understand the differences between 1st and third party collections quite well.. do you. I am also well versed in contract law, civil/criminal investigative procedures and laws governing the operations of businesses (adding here that I am a partner in company with an annual revenue of +$5,000,000 and a staff of 25.

This site serves 2 major purposes 1) to help those wanting to become better at managing their debt and 2) to servce as the voice of those who have been harrassed, dealt with immorally and illegally.

At any point when I mention the word recording, gaining someones name and company prior to announcing the call is being recorded is fine. There shouldn't be a problem with recording calls if no laws are being broken. All incoming calls in most states are allowed anyway, without the consent of the other party.

Reading over another post that I made, I do state that hiding from these debts is a bad idea. Changing your account number and trying to make other arrangements isn't against terms when I mention contact them to make other arrangements.
I'd first like to say that changing account numbers doesn't hide you from the fact that these loans taken out are still owed. They only put you in a safe zone, while you get your finances in order so you can take care of each of them. Changing account numbers protects whatever funds you have that are getting deposited, and keeps you from getting NSFs from your financial institution. Although I do recommend this as a safe option only, I also recommend getting the loans paid as soon as possible. Payday loan companies charge extremely high interest rates, which can hurt you if ignored.
Most of the members on this board that are in collections, are dealing with shady operations. This can be proven, as a member already has a call that was recorded when such threats and obsene languaged were used. Threatening someone into paying a debt by noon, or they'll go to jail is against the law. I will be standing next to the member during the complaint process. There are very few collection companies that are not shady, when it comes to payday-loan recovery.

I do not know the story behind each member, or why they decided to take out a loan. Mistakes can happen, I know that. When the loan companies aren't willing to cooperate under this reason, it forces the consumer into chaning account numbers while getting everying in order.

ipaymybill....you've made your point very clear on this board. You've made it clear that you pay your bills. You aren't helping anyone on this forum, so I suggest you take your bullying elsewhere. There is IP tracking information we can obtain, and if such harassment does not stop, we be forced to ban your IP.

As far as tricking companies into not paying, it's not a trick if laws are violated on the collection companies side, or if mistakes were made on the loan companies side. A few loan companies have debited amounts for weeks and weeks and weeks, saying the loan was not paid, when it was actually over paid.

Mike
