Hi Shirley,
I'm sorry that you are getting nowhere again. Is this a collection agency? Are they still trying to collect on the debt after you disputed it and asked for a validation? If so, file a complaint against them with the FTC. According the fdcpa laws, it must be validated before they can continue with the collection process. Plus, they are breaking the law if they are ignoring your do not call order. I'm dealing with a similar situation myself right now. :?

They actually said they don't validate the debts. Obviously they have received your request other wise they wouldn't have responded like that. You are protected under the fdcpa laws. I learned that today! I have contacted an attorney in my area regarding Simm's Associates and I am going to meet with him later this week to see if I have a case to sue them :P

I think one of my payday loans was turned over to Oxford because the name sounds familiar to me. They never did validate the debt in my case either.

You are doing everything you can, Shirley...have you tried disputing with the credit bureaus? I can't remember everything regarding this account, there has been so much! :)

oh yeah, the credit bureaus are sick of my @ss!! I have disputed and disputed--they keep coming back saying its mine. I finally wrote and said okay, they're validating to you but not to me--let me see their validation. They wrote back and explained that they do not go into much detail with their verification. mainly check the SSN, name and address kind of thing. They don't ask for contracts or anything that the debtor signed as proof. bogus huh? It kinda makes me mad because the bureaus report things and they really do play Gods with our lives in the way that they report. What they say can be very damaging. Yet (other than getting a free copy), we have to pay to see what they wrote about us. But thats what disputing is for and its also up to us to constantly look over our report to make sure nothing bogus is on it.

Ipaymybills,
You do not know any of these people from Adam, how dare you be so condescending! You are truly making a grand fool out of yourself with this nonsensical drivel. Like I said in my last reply to your last exact-same post (is there nothing creative or original about you??) Consolidation is not weasling debt down, it is gaining control over it. What is being complained about in this forum are collectors who break laws and their agencies who add on phony charges in order to bulk their overhead. Please do not post here again, this is not the appropriate arena for your crap.

Shirley,
I have also heard that the bureaus do a very basic validation process as well. That is why I asked...to confirm this. Did you dispute online, or did you use a handwritten letter? I have heard that if you handwrite a letter, in purple or teal font (so that it can't be read by an automatic scanner) and send it certified mail, not with return receipt (this sends it to a different department supposedly) people get more of a human response this way. You might want to try something like this. *shrug* Other than this, I don't know what to suggest!

That's weird about the colors of font! I guess that would make a difference, as computers are probably programmed for black or blue font.
This reminds me of our Biology teacher in High School. He got hit in the head by a shot put and ended up colorblind somehow from it.
He could not see anything bright yellow--So if you wrote curse words on your papers with a yellow highlighter, he couldn't see it..That was always fun...lol

No, he really couldn't see it...lol Some classes were interesting, because he at times would have to ask us what color things were. We had a rock project at one point and this new kid was trying to identify a certain rock, and the teacher said, "What color is it." and the kid said, "It's BROWN, duh! Don't you know your colors?" and the teacher said, "Yes I do..But my eyes don't know them anymore." LOL It was so funny.

I have had this gal leave VERY snotty messages on my phone and she also keeps calling my parents home bothering them. Is there some way to stop them from calling my parents home, isn't that invasion of their privacy? If so, how do I go about stopping the calls to them, they are elderly and don't need to listen to this witch.

A very simple way for them to stop calling is to pay your bill, the reason being, when you instruct an agency to C & D. They either recall it, sell it, or refer it to another c/a to handle. You'll have to go through the same hoops over & over,......

Who is to say this is even valid. Never heard of this place and they won't cooperate with a validation of this. Who is to say this isn't some sort of scam. I've always paid my bills, early even and paid more then what was asked.

Hey, why not pull a copy of your credit report. If it shows up, call their agency and verbally request validation/dispute it. If the seven year time to report it has run on the account, who cares? don't pay it.
