Why are these calls so Rude?
Date: Tue, 03/21/2006 - 18:53
I don't understand why the rudeness, the hateful tone, and the talking not allowing me to say anything.
I recieved a call from ACS 800-220-0605 215-320-0424 (per caller ID). This has been on my caller ID for about two weeks, with message for a return call regarding the letter they have mailed. I just happen to be home tonight when they called, so I answered.... MISTAKE. This Nancy Gray was rude hateful, and wouldn't stop yelling long enough for me to ask or say anything.
I eventually hung up on her....
I told her, I didn't know what she was talking about and that I would not discuss anything on the phone, once I rec'd the letter then I would talk to someone. She said a letter was sent yesterday. I have been getting messages for weeks about a letter sent. Strange.
Any advise from you who seem to be so calm. I am at this point ready to run for a while, to let off the steam.... She upset me so, I would never work with someone who talks to me this way.
Thanks for your site, it has helped me lately more than you'll know. I just need some calming support right now..... :x :x :x

Calm down. These people love to use scare tactics that they can't back up. They are not allowed to torment you when they call. Stand up for yourself next time they call. In fact, I would call them and let them know that they are violating the law by doing so.
Thanks for your calm reply, but It's so much unexpecteded.

Why the attitude? I can't ake anymore calls from this company. I guess I will have to count on the mail.
How do I do this? I have some debts, but not more than 3 that are less than a toal of 3,000.00. I can't pay them right now, and can't take these calls. What can I do?

Take a deep breathe!! Find out, figure out why they are calling you and then proceed. They are Academy Collection Service and do not try to deal with them. I tried, trust me and they won't deal. Here's what happened to me. They got a credit card of mine that was a QVC card, GE Money Bank. The balance is only $670 and whoa, don't talk to me that way about $670. I finally just told them that I was going to deal with the original creditor and not them. Well they did not like that...at all. I finally had enough after they called me 4 times a day for 3 days. I called and asked for their fax number and faxed them a cease & desist letter. Then they called once more (on my cellphone) and asked for my debt consolidation/management company (T&C), I think she wanted their phone number.
Sorry this is so long...after that T&C sent a proposal to GE Fin/QVC and today I found out they accepted the proposal.
Do not try to deal with ACS, it's impossible, they started out nice but they're not. Deal only with the original creditor. You will get the letter but just keep asking for it and if you talk to them tell them you'll deal with the original credit NOT THEM. You can do it, trust me!! Take care!

I would send them a cease and desist letter, telling them you no longer wish to have them to call you at home or work and that any further communication between them and you should be done by US mail.

Don't work with them! Whatever this is, consolidate it or settle it with the original creditor. Don't ever disclose your personal info to someone like this. How on earth can you trust someone who violates federal law? They will steal from you if you do as they say and do a check by phone. collection agencies like these are charlatans!

Thank you all, I am so upset right now... Still shaking and it's been a hour already.
The thing is, she never said who se was calling for/about so until I get the mail I don't know anything. She just kept yelling you know you owe money and need to pay me. Yes I owe money! but to who and why was she calling. I will never answer a call by them again, but this may have me in court, and I don't want that either. I am so confused. If I don't answer calls, will they sue me?
I am scared. Wish I had the money to pay, but right now there is 20.10 in my bank account.

Will this stop them from calling?
Sorry for the questions, I am still just reading, and trying to learn the procedures.
I know I owe some people, and would like to make arrangements I can live with to pay. But with Nancy there was no discussions available.

That's is exactly how they are. Jami PM me your email address and I'll send you a copy of the letter I sent (actually only faxed) to them. They way they started with you is exactly how they started with me. Don't let them get to you.

Jami - deep breath! I know it's frustrating trying to deal with these people, but we will walk you through. First off- they are breaking the law by threatening you and yelling and such. Do not be afraid of them, put them in their place. Second - be sure to send that cease and desist letter by certified mail with return receipt. I would also recommend faxing a copy, that way if they feel like following the law, the calls will stop immediately. Third - follow through with filing a complaint to the FTC. Don't slack on it, they need to be informed of what this company is doing. Deep breath, we will walk you through this!

Under the fdcpa they can call even before a letter is sent, however they must also send written notice of their purpose within 5 days of initiating contact (i.e withing 5 days of the first phone call they must send a written notice). Many agencies will conveniently ddisregard this little requirement in the hopes they can pressure you to pay without enforcing your rights under the laws of your State and the Federal Government.

I have gotten calls from collectors that scream and yell and won't let you get a word in. The people who use these tatics are not normal or reasonable. The fdcpa means nothing to them. I got the ideal to record them from this forum and the next time they called I put them on speaker and told them I was recording them. They hung up and never called back. I did report them to the BBB and the state attorney general.

Jami, inorder to make sure you protect yourself adequately, when you send the letter tell them that they may communicate with you in writing only. Also in the letter reuqest that taht provide you with complete validation of the debt including the name, address and phone number of the original creditor, amount owed (principal) amount of fees and interest (including how calculated, and appliced by whom. Also require that they establish the legal basis for charging any fees/interest.
Definitely send it return receipt requested, or if that costs to much for you, do the follwoing. take the letter to the post office aand buy an envelope at the counter, take the letter and receipt and make a photocopy of the receipt clipped to the letter. Then, send the letter, keeping the original receipt and the copied, letter/receipt. This should provide sufficent proof of mailing if needed in the future.
Most importantly, relax, and ask all the questions you need.

Jami, keep the FTC, the BBB, and the Attorney General in the state of this agency close at hand. They will help you fight this. I'm sure that these collectors are full of it and that explains the childish bahavior.

Tell them from the start that you are recording the call. Say something like, "excuse me while I turn on the tape recorder". I'd bet they'll act very different then.

Okay - these nutcases just called me - at 10:06PM. Do they not realize they are breaking the law with every phone call made. They are idiots. I pick up the phone half the time and let them talk to dead air.
I just set it so when their ph# comes up, it rings silent. Problem solved.
It's not that I did not want to pay the debt they are calling about, I simply can't. I was making my way to a heart attack stressing about bills... and I can tell you this. I am sure as HELL not going to let some little half ass company get to me like that to the point where I am stressing again.
JAMI - it will be okay. My advice would be to ignore them and check out the laws in your state. In my state (NC), I am not liable for any debt which has been charged off after 3 years have passed. I am sure the next 2 will fly by as quick as the first has.
And, JAMI, remember that as far as all the things going on in the world... this is miniscule. Yeah, we made a mistake - we'll pay for it now on our credit reports - but no one died and ALL WILL BE WELL! :)
Good luck to us all with our finances in the future!
Sending up prayers for you all!
