My husband has just gotten a notice from our districk justice from lvnv funding is taking him onto court for a credit card bill from Bank of America. His contract was with The bank not LVNV. How can they take him to court and what can they get? I contacted LVNV and they gave me 3 differnt names of their own business. As far as I can see they bought the debt from Bank of America so how can they keep charging interest on a closed account also.

digaroo,

Contact a lawyer with all the papers you have. If the collection agency has bought your account from the original creditor, they become the first creditor and gain the legal rights too.

If you wish to avoid the judgment, you can ask them for an out of court settlement. Keep us posted.

P.S. if you search BBB website, you can see the additional business names they use as well.
