Well, he has not got back to me yet. I am in "one of those moods today." and was really irritated that he had not contacted me back yet. It's been 2 days.
So I wrote back today and said,
"I do not appreciate being ignored by your company. If I do not hear back within 24 hours I will consider my account paid in full and will not authorize any deductions from your company.
Ohio law states that the interest on a payday loan may not exceed 5% plus $5 for each $50 loaned. On a $200 loan, the fees should be no more than $30. So I have over paid. I'm not asking for a refund, but I am asking to close my account.
If you are willing to make payment arrangements for April 15, I will pay the $260 I contracted with you to pay. If I do not hear back from you in 24 hours, my offer will be retracted and no payments will be authorized by me."
I just got so bold...lol

I'm just not in the mood to be ignored, and I won't be. I'll know more in 24 hours. That's his deadline..

Ya, way to go Jessi, I'm very proud of you as well. You're all over these forums, and fighting with all these lenders. You're great. I hope all people that need credit councelling read your posts so they to can try to scam the lenders out of money that you sign a contract for and agreed to pay back with interest incured.
You are truly my hero, I hope my kids grow up to be just like you.
lol, thanks for all your inspiring words.

What a coincidence, Guest. You're my hero too--Hiding behind your computer screen.
I HAVE paid back more than is legal in my state. Had I KNOWN what was legal at the time I took out these loans, I wouldn't have taken them. Same for everyone else who is in this situation.
And obviously these lenders know what they are doing is wrong, or they would have a leg to stand on when someone calls them on what they're doing.
Go ahead, make another comment. You're good entertainment.

I would be happy to step up to the plate for you Jessi! After all, we had some good times busting on Protocol! That was so much fun! So, want me to call this clown and say that I'm your lawyer? I could catch him completely with his pants down making a big fdcpa blunder, then heads will roll!

Truthfully, contracts are only as good as the paper they are written on, and are only enforceable if permitted under state law. Many state laws do prescribe the maximum amount of fees and interest that can be charged, and a private contract cannot change that.
These lenders and collections agencies that skirt state laws and do not get proper licensing and do not comply with all applicable State and Federal laws are no better than the people who refuse to pay their bills.
One thing you will notice if stay around for a while most participants here WANT to pay their bills, they are simply exercising their rights under they laws. If you have a problem with that, then you need to consider a career change as collections is making you to cynical.
