Be careful dealing with MRS associates. They will harass you even if you AREN'T who they are looking for. A 'Danny Mars' left a message on my cell phone saying that he "had important imformation that I needed to be aware of"...Never mentioned what the call was in reference to, who the company was, or anything. (This is against fdcpa disclouser requirements). I only reason I knew it was a collection Agency was because MY Caller ID showed all "0's" with the words "Collection, Collection"...Anyway, I received another call a few days later. This time there was a live person on the other end. This person didn't identify himself, his company, or what the call was about...(More violations of the FDCPA). He asked for someone I had never heard of (I assume someone who had my cell number before I did). I told him I was not that person ahd didn't know who that person was. He started talking to me as though I was lying to him and then started harrassing ME!!!

I just received a letter from MRS it says my account has been turned over to them for collection, and has been pre-qualified by Capital One as a lawsuit eligible. if they don't hear from me its subject to litigation. but my payments should be paid to Capital One. I was getting ready to send a letter to capital one to try and settle the debt. should I still send the letter or do a debt validation with MRS. Any Suggestions.

This letter is being sent to you in response to a alleged debt. Be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.
This is NOT a request for verification or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you

What I need you to provide as the debt validation is as follows:
1. What the money you say I owe is for;
2. Explain and show me how you calculated what you say I owe;
3. Provide me with copies of any papers that show I agreed to pay what you say I owe;
4. Provide a verification or copy of any judgment if applicable;
5. Identify the original creditor;
6. Prove the Statute of Limitations has not expired on this account
7. Show me that you are licensed to collect in my state
8. Provide me with your license numbers and Registered Agent
9. Proof that the collection company owns the debt/or has been assigned the debt. (You are legally entitled to collect this particular debt from me.) This is basic contract law.
10. Complete payment history, starting with the original creditor. (I need to have proof of my payment history with original Creditor, what the amount of the debt was when the creditor assigned the debt to your company, and what fees/interest has been tacked on to this debt and how you/they determined these fees.) This requirement was established by the case Fields v. Wilber Law Firm, Donald L. Wilber and Kenneth Wilber, USCA-02-C-0072, 7th Circuit Court, Sept 2004..
11. Copy of the original signed loan agreement or credit card application. (My contract with the original creditor establishing the debt between us.) This is also basic contract law.
At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major Credit Bureau's (Equifax, Experian or TransUnion) this action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent
I will not hesitate in bringing legal action against you for the following:
1. Violation of the Fair Credit Reporting Act
2. Violation of the Fair Debt Collection Practices Act
3. Defamation of Character
If your offices are able to provide the proper documentation as requested in the following declaration, I will require at least 30 days investigating this information and during such time all collection activity must cease and desist.
Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes any listing any information to a credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.
If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately.
It would be advisable that you assure that your records are in order before I am forced to take legal action.

These folks called me today...I had to call them back because I didn't know who had called. I said I was my roomate since I didn't know who they were and said simply they needed me to call because they were handling my "file" never heard any CA refer to it like that. I would say send a validation letter...seems fishy.

I work close to MSR building in Cherry Hill, NJ, location and let me tell you that the harassing part is not the worst. They are very nasty people that don???t respect other people???s parking lots. Also, they do not respect the surrounding areas, because they are littering with McDonald, Burger King, and Dunking Donuts bags and leftover food. And the funniest thing is the dress code they have for work. It is outrageously horrible!!!!!! I don???t know where they go shopping, but they definitely know how to make a fashion statement. For example, the ???Big Girls??? are always trying to fit into the junior size clothes, and all the curves are exposed (the ???muffin effect???) to the point that we all are going to need a therapy for the visual shock we get from them. You really have to see them to believe it. Stacy & Clinton from What Not to Wear would have a hay day with this Bldg. I also wonder how they can afford luxury cars/trucks (BMW???s, Volvo???s, Mercedes etc.) Oooooh wait, that???s because they are stealing people???s identities while at work. Even one of my fellow co-workers saw 2 of their fateful employees walking by our Bldg. sharing a joint. Now that???s a fortune 500 company.
This company may be fishy, but they are also VERY CREEPY...
I got a call from them saying, "Please hold for some important information for Michael XXXX" MY EX-HUSBAND of 19 YEARS AGO!!!! We now live 2500 miles apart (have for 15 years) and I haven't had anything to do with him since the divorce (no kids, thank God). How the hell they got my cell number after all that time is beyond me (I have had at least eight different cell numbers, including business ones in that time). Freaked me out.
Definitely take the advice given here, and send the validation letter. Most collection agencies are looking to prey on those who are not savvy enough to protect and educate themselves. They want to make the fast and easy buck. Very few will jump through that many hoops to collect the usually small amounts owed.

Just curious, is this something they HAVE to do, and is it supported in any previous case that can be stated in the letter or other communication that may be necessary? This is the only paragraph from the letter that concerns me/caused questions.

If you guys have the time go to www.ripoffreport.com and put a report in about these people and ripoff report will investigate them and if anybody does a search on them in google ripoffreport will come up under their name and will ruin there so called business because people will catch on.
