Hi I had a question if any of you have had any dealing with them and a over due balance????

Collection threats. A collection agency cannot disclose your financial obligations to a third person like your employer. They can only contact your employer to verify your employment. Otherwise it will be considered as violation of laws and you can sue them up to the extent of damage caused.

Ask for validation. This is must when it comes to collection agency. Know your rights very well so that nobody can get your scared.

ABC Distributing is a mail order company primarily for businesses. Although you can buy lots of stuff...toys, etc, the company sends out their magazines to businesses and most things must be ordered in bulk. For example, you have to buy 6 of the same doll most of the time, etc. If I remember correctly, you have to provide a tax ID (which usually belongs to the business) and the items are usually mailed to the business not a home address. I worked for a doctor who offered to let us order from this magazine all the time, but I never used it. But I know that the things would have been ordered under his tax ID, although you can put the name of the person ordering the items, which does not necessarily have to be the owner of the business. I think in the last posters case, it would fall back in the hands of the business, and if they used their own name to order, then the business may have to go after them. After all, these magazines are provided to the company, not all the employees to order from.

Guest that isnt completly correct. They do send the magazines to businesses but you can go on thier website and reqest a magazine to be sent to you. In addition to that you do not have to provide the company's tax id number you only have to supply your own social security number. They have never asked me for my company's tax id number. Also you suppossedly get better shipping when you buy more than 3 which most of the time doesnt do you any good because 90percent of the time they dont send it all together and they send thier magazines in the box to make it weigh more. So these magazine arn't only for the company.

has anyone dealt with this company for debt collection? My mother has received numerous calls that are threatening, she has been called a liar, and they have cursed her over the phone.......any suggestions? Can't pay the bill in full, and they are not willing to negotiate. If you ever use Transwestern publishing for your ads, this is who you end up with for any outstanding balances.

No, the collection agency can't use such collection practices for recovering the debt. This is illegal as per the federal laws and you have a legal case against them. Get an attorney and sue them on charges of using abusive and profane language during collections. If they don't validate the debt account, you can sue them for one more violation.

The company is required to send a debt validation in writing after making the first phone call. If you have not received anything in the mail, send a debt validation letter. Make sure that you send it through certified mail with return receipt requested. The company must not contact you until the complete information of the debt is given to you in writing. In the meantime, if you know the name of the credit company for which they are collecting, work out payment arrangements with them. The dealings with them will be quite easier. Hold your stand legally against this collection agency. Read the fdcpa for better information about your legal rights. You will be able to stand against them in a strong way.
