original debt and asset acceptance both on cr and reaged?
Date: Tue, 04/04/2006 - 09:11
Been looking around here a lot lately but I still have questions.
I had 2 cc opened in 97-98 both owned by retailers national bank, the last time I used these or made any payments was at the latest 2000. Those two are on my CR as charge offs with last activity dates as n/a/
Now, the same debts I'm assuming were bought by Asset Acceptance which are on my CR also and have an open date of 2003 and also last activity dates of n/a.
From my understanding, it's illegal for them to put the date of 2003 on there (Did they reage it?) and also, I think both of these accounts are now past SOL, if not, getting very close.
Do I send a validation letter to the original creditor or the CA or both?
ANy help would be a appreciated, thank you!!

[list=1]One account cannot be listed twice on your credit report.
Collection agency cannot change DOL, it is illegal.
SOL for debt collection varies among different states. But bad debt reporting time is same all over the country and it is 7 years. So the charged-off accounts are supposed to be on your report up to 7 years from the date it went charged-off.
You can dispute multiple entries with credit bureaus also.
BTW, has this collection agency contacted you ever?

They have tried to contact me by sending me some stuff in the mail that I just threw away. Other than that, they do not have my phone number or anything.
So since both these accounts are listed twice, do I send a letter to the CB about that?
Thank you

Yes, you should send a dispute letter to credit bureaus. Highlight the items that you wish to dispute. Attach copies of relevant documents if you have any.
If the SOL for debt collection is over, paying a single dime or signing an agreement will restart the clock.

Absolutely dispute those trade lines. I will bet you a penny that the disputes will not be responded to and they trades will fall off your CBR. Keep me posted.

Kathryn,
Judgment is listed under the Public record section of your credit report. If you have paid the judgment it should be reported as satisfied judgment.
It seems that creditor might not report it any more. BTW, what is the status of the two items?
Quote:
Public record information, generally gathered from local courthouses, including bankruptcy records, foreclosures, tax liens, court-ordered payments, and late child-support payments. This information is used to determine if you have previous defaults or legal judgments against you. For example, a mortgage lender will want to know if you've had a past foreclosure before granting a home loan. Derogatory information can generally remain on your credit report for up to seven years, except for bankruptcy information, which may be reported for 10 years. |
