I received an email from Quikpayday about the payment being returned unpaid. First of all, I had revoked their authorization to withdraw funds 2 WEEKS ago, and sent the notice via mail and fax twice each. I also sent a fax informing them of Virginia law, which requires anyone lending to a VA resident needs to be licensed in VA, and there is a $15 per $100 cap on fees. This is the reply I received from Quikpayday today (note the rep doesn't acknowledge receiving the fax or letter, nor being contacted by T&C for payment arrangements). Any help with response would be greatly appreciated.

Thank you for your e-mail regarding loan repayment. Our records confirm that the balance on your account is currently for $620 (which does include a $20 return fee). Our records do confirm that we have received one fax from you of your bank statement. All of our transactions were blacked out and we were unable to read this.

I have included a copy of the Utah Loan Agreement in which you signed when requesting the loan. You were required to sign this before we allowed you to loan the $500. You did sign the UTAH loan agreement, and not the Virginia loan agreement. We are a company based out of Utah and thus fall under the utah legislation

In addition to direct withdrawal from your checking account, we have several payment options to assist you:

email them back saying that regardless of the contractual agreement, they are required to be licensde in Virginia, and by loaning to you they have violated Virginia Law. If they do not wish yo uto involve Virginia authorities, you ask that they consider your account closed, paid in full. tell them you expect a response within 48 hours. and let us know what happens

In reviwing the Utah law, it specifically states that they need to inform you as to what states they are licensed in if they make internet payday loans. I would interpret that statement, along with the laws of virginia as evidence that they are loaning illegally to you in Utah as well.

Thanks Polly, and JJ.

JJ, I read another post you wrote regarding withdrawal attempts after they have been notified of revocation. Do you remember which US code that is under? And I thought the same thing about the Utah law; it specifically states that companies need to check with other states (simply stated)
