Hi all,

Please give me some advice. I am being sued by lawyer on behalf of a bank for non payment. Because I don't have a steady job, I've unable to pay the bill. Is there really a way to reduce the payment through negotiations? If so, should I do it with the bank or with the lawyer??

Since your bank has already appointed the lawyer chances are they won't negotiate with you any more and you have to contact the lawyer. But there is no harm in inquiring with your bank that if they will settle the account directly with you or not. If they say ???No', then negotiate with the lawyer.

Have you received summon or just a lawyer has contacted you on behalf of your bank? How did you come to know that you are being sued?

Hi Stan,

I got a summon from court. One thing I notice is the letter is mailed by regular post office stamps instead of certified - which is unusual. But the content of the paper work appears to be real. It has the stamp of the clerk of the court and it gave me 30 days to reply to the summon.

Do reply to the summon if it looks legal. If you do not show your presence at the court, things might shape up against you. You can explain the situation to the judge before any decisions are being made. In most cases, you will be set a payment plan by the court and you will be asked to pay it without defaulting in it.

Do you know if I should contact the lawyer to negotiate the payment. I can come up with about 50% of what I am being sued for. If they agreed to it, I am hoping they would drop the lawsuit. I just don't want my name to go on the public record and I just don't want to deal witht the hassle. as far as the response to the summon goes, does it have to be prepared by a lawyer or a letter will do ? should I get a lawyer involved in the negotiation ? Thanks for the help.
