Collection Agency called this week

My husband unintentionally bounced a check and the store sent it straight to a collection agency instead of notifying us so we could pick it up. Now the CA wants us to pay $88 on a $20 check. They called on Monday and asked for me... I did not write the check. My husband answered the phone and told them to call back on Friday and he would work something out. They called again on Tuesday and wednesday. When they called on wednesday I lost it with them and told them if they called again before friday I would report them for unfair practices. They didn't call until this morning, then they told me they were coming after me for the check instead of my husband. My husband wrote the check. Can they do this? The woman got ill with me and said they could come after anyone they chose and could charge any amout that they wish. The company was Security National

Handle this situation very calmly. Since the check bounced and has been sent to the collection agency, they are trying to recover the money from you. You can still make the payment to your original creditor as the account might be still with them. If they agree to accept the payment from you, CA has to back off.

It is possible that the debt can go higher with the financial charges tucked into it. But the collection agency or the store has to present the accurate details of the account in writing. They must furnish the calculation of the interest rate and other charges. You can always request from the collection agency if this information has been given to them by the store. Try to make arrangements with the original creditor.

Don't get tensed from these threats. If you feel this is incorrect, you can file your complaint at the local AG's office for proper actions.
