There is a loan company who continually calls my home and my mothers home (I do not live there). I have asked them to correspond with me by mail, yet they continue to do this. What can I do?

I think you can send them a Cease and Desist letter...What kind of letter did you send to them? Do you pick up the calls when they call? If you pick up when they call, they should not call your mother's home because they can only call references to verify your phone # and such and thus they are limited to what they can tell her. I would send them a Cease and Desist letter which can be found by doing a search on this site...(I'm not sure where it is exactly but it's found in a e-book that's mentioned on this forum).

Original lenders are not abided by fdcpa, hence they are not obliged to a C/D letter. But you can send them a similar letter asking to rectify the mistake in their record. It seems they have your older number. Besides sending the letter through CMRRR, send them Fax, email too. It will accelerate the process.
