Date: Wed, 04/12/2006 - 09:46
Can a law office file a litigation over my credit card debt? I got a voice mail at my workplace saying they will do that.
The law office is called the Law Center of Makel Ann Wright. Bud Hibbs listed this office as one of the worst debt collector.
Please advise me how to response to this.
thank you.

They can, but this is most likely a threat. Have they sent you anything in writing? If not, tell them you would like something in writing pertaining to the debt they are trying to collect. You also need to write them a letter asking them not to contact you at work. Send it certified mail return receipt requested, and ask for validation of the debt at that time. Thanks for the reply.
How likely is the litigation?
And is this law office essentially a debt collector?
thanks again

Apparently this law office is associated with Account Management Services, and Makel Ann Wright is only licensed in New York. So, she may not be allowed to collect from you unless you live in New York. Check your local attorney general's office if you are not in New York.
I think Makel Wright's primary business is debt collection, not litigation. Therefore, they fall under the fdcpa and must follow it.
I couldn't tell you how likely litigation is, but I would definitely contact the original creditor, try to work something out, and send a validation letter to the attorney.

Go through the posts of Virginia_Legal_Defense in the thread mentioned below. You will understand how it works. Collection agency cannot take legal action against you unless they are authorized by the original creditor.
It really sounds like a threat. You should ask for validation first. Also consider contacting the OC.
