The belligerent woman on the phone explained to me in a ocndescening voice that payment info could ONLY be sent to my attorney and that she was following the way the legal system is set up. I told her that I believed I had the right, as a consumer, to receive verification of that debt and account activity. She yelled - YELLED LOUDLY - that I indeed did NOT have that right and that I must be too ignorant to undersand the legal system.
I had sent a registered letter yesterday but needed info ASAP for appt with attorney tomorrow!

If you are not being represented by an attorney at this time, then you DO have the right to your information. Not only that, but in the U.S. the law allows you to represent yourself if you choose to. Sounds like this is a third party collector, and their representatives are probably not trained much. I wish you had recorded that call.

Hi there. I am an account representative with my employer, and the consumer has every right to their payment and account history. Of all the years working there, we have never denied a customer their request for account history regardless of the account's standing.
Sounds like they either are trying to scare you or they just have no idea what they are doing. If they are a third party representing Providian, then they may not have all the information, even though they should. If my company has to send accounts over to a third party, the account history is one the first pieces of information to be sent over.

Though they have no right to try to collect it, many junk debt buyers such as LVNV Funding, west asset management, NCO,...etc. Will at first threaten you, hoping that you will send them any token payment (this will re-start the SOL clock, and bring it back into the SOL). If that doesn't work, in some cases they file suite, hoping that you won't show up, and get a default judgement. Is this extortion? Yes, it is.
