In Canada, collectors and skip tracers have to be registered and licensed to practice their profession. If a collector is found not to be registered, their company can be severely fined. The collector can also civilly charged as well.

Collection companies have to be registered, if they are not, severe fines and dissolution of business can happen.

Canadian agencies can call into the US without being licensed or bonded. US based clients should be aware however that a Canadian agency that contravenes any section of the fdcpa, FCRA or UCC may subject their US client to litigation.

US creditors should use Canadian agencies for Canadian debtors and Canadian creditors should use US agencies for US debtors. Doing otherwise is at your peril and certainly not covered by Errors & Omissions insurance. Remember, an insurance companies job is to collect premiums and not pay out claims.
