My Payday Loans...
Date: Fri, 04/21/2006 - 12:43
Hi,
I'm new here and have found sooo much helpful information! I was/am in the payday bind like so many others are/were and was swamped with the fees that my entire paycheck went to.
Well, I was tired of paying all the fees and decided that I would close my account and open a new one and let the pdl's go into default and then try and pay them off.
I contacted T&C (thanks to you all here at the boards) and advised them that I needed to consolidate my PDL's. They were great to work with and I've sent them my retainer fee.
What I need to know is... If I originally took the loans out in FL and I now currently live in GA, which state laws should I go by? I know payday loans are illegal in GA and all of my PDL's were from online companies.
My loans defaulted last week Friday and I have received only a few calls on my cell phone from about 3 PDL's (I changed all of my contact info before I defaulted). I'm hoping that T&C got to them and are working out some type of arrangements.
I know that I've paid well over what was due to them because the fees were so high.
What if anything can I do to see if I've paid too much?
Thanks for any help and THANKS to the entire community for helping me learn so much!

You can try writing a version of the letters that many here have used to show internet lenders how much the consumer has overpaid, vs what state law allowed. FL only allows 10% plus a $5 verification fee, so $55 for a $500 loan. Odds are you paid much more than that.
When did you move to GA, before or after GILA went into effect in 2004?

I think you should contact Consumer Protection Office of your state and inquire about this. Or a lawyer can give you some more info. This is a tricky situation indeed.
However, if you think that you have paid them enough, you might send them a letter asking for considering it as paid in full. Keep us posted.
Thanks for both replies. I will view the letters. I moved to

I moved to GA in 2005. What is GILA?
Thanks again and I will keep you posted.
