New with dealing with collection agencies...

I currently owe a collection agency, I can't up and pay the $3500... how do I go about talking to them? I have told them I would try to get the money together but have been unable to... they call here everyday leaving messages! I am trying my best to come up with money.


Keep your ground and offer the payements you can afford.

You could even send them a packet with the following.

Cease and Desist, written correspondence only letter

Payment offer letter, stating your payments you are willing to make

And if you can, a "good faith" payment of the amount you are willing to pay monthly.

Tell them that by cashing the check they are agreeing to your terms. Send this all Certified mail, and get a return receipt.

Then if they try to take you to court or any other irritation from them, you have proof that THEY denied your payment.s

First, you need to know that the call from the collection agency is a genuine one. They must have all the details of your account and it should be given to you in writing. If you haven't received anything yet, send a debt validation letter. Samples of this letter are available in this forum. You can tailor it according to your needs and send it through certified mail with return receipt requested.

After you have got the complete details of your account, offer them a payment plan suitable to your needs. You can negotiate with them and set up a monthly payment. In most cases, they insist larger payments but you should keep sending money to them even if they don't agree to it. After some period of time, they will accept your proposal.
