Can a person threaten jail over a payday loan

Hi

You can't be sent to jail for not paying the debt. Moreover, debt prisons have not been into existence since 1860's. Some disreputable companies are using this as a scare tactics to harass the consumers. They think that they can recover large amount of money from the people out of fear. No federal laws support that a person can be jailed for not paying the debt.

You have the legal rights to report the conduct violations to the BBB or the FTC. Copies of the complaints can be sent to your local AG????????s office too.

Can payday loan companies take money out of your account without your premission after you have already told them you did not have the money.

Hi DORLEEJOHNSON

When you take a loan from a payday loan company, you authorize them to do the debits from your checking account on each payday. Since they have this authorization, it doesn't matter much for them if you have money in your account or not. Although it is an illegal activity, but you don't have much to do since you defaulted on the loan. At this point, it is recommended to change your account number and stop the company from making further debits.
