In nc can collection agencys go after real property after death

Did you receive the pm I sent you last night, with the NC law? I couldn't get into the forum to post, but I was able to send a personal message.

According to NC law, real property can be held by the collector (not collection agency, a collector in NC law is the person assigned to watch over the probate of the will, distribution and settlement of assets), and sold/exchanged to pay off valid debts.

Hopefully the collector for the estate you are asking about has taken the steps to make sure the debt is valid.

hello my name is Meloney,my mom passed in november from cancer leaving my dad behind.she had tumors in her brain wich unfortunatly made her do some silly things like open a credit acount and shop on HSN.my dad had no idea.I called two credit card companies for him when she passed,one wrote it off the other said they would,but are now calling my dad daily telling him they are going to lean his property.can they do this?he was not on any of the accounts.

I am sorry Damien to hear about your loss. Credit company will try to recover the amount from your mom's estate, if she had any. If your dad has a portion in that property, he will have to allow the company to recover the debts after the lien is placed. Make sure that the lien is done in legal terms.
