My husband is 68 years old and has been forced to retire due to illness last year. At that time we had a small home business doing insurance inspections for a company in Colorado. Before that he had been forced to retire from a Company that he was with for over 16 years as a Manager. Since 2001 our finances had steadily gone downhill and we were using Credit cards to keep up the expenses. As of August 2005 we have $120,000 in unsecured credit card debt. We were able to file a Chapter 13 and have a payment plan of $875 per month $385.00 for the Auto and the rest was unsecured debt. At this time we owned a home and had approximately $25, 00 in equity.

Since entering the plan in august of last year we had a mortgage with Ameriquest ARM that increased out payments by $600. In the past six months. On top of this our septic system failed in January of this year due to heavy rains etc., we petitioned the court for dismissal this was done in March.

We live with our sin in law and daughter, two children plus my elderly mother who is 84 years old They have all lived with us for over ten years. My son in law has helped us out all this time and had an option to buy lease. This April we sold the home to him as he was the only one in the family that qualify at this time to get out of the Ameriquest mortgage, We sold the house to him for the amount owed plus $30,000 $25,000 for the septic and $5,000 for the deck that will have to be replaced. Of course this helps us out as we now still live in the house and we now rent from them for $800. Per month.

My question is how we can get the unsecured debt to go away as we only have approx $250.00 a month extra that we could spend to pay down on the credit cards. Our Bankruptcy attorney advised us to disappear for five years then come back to see her and then we can file a Chapter 7. This is really not an option for us.

I am sorry to hear about your situation but you need to come out of it with positive thoughts. Your total debt is quite a large amount and you need to take control of it as soon as possible.

One of the consultants in your area will be calling you up for a free counseling. Discuss all the accounts with him and know your repayment options. He will negotiate with your creditors and arrange the payment plans as per your needs.

Perhaps you can take a debt settlement program for clearing off your past debts. Stick to the plan as much as possible. Your credit ratings will improve after you make regular payments to the accounts. You will have to wait for some time till you find yourself in a better position from now. You will need to live on some restricted budget and avoid unnecessary spending. This will also count in a positive way.

I don't know if this helps, but you can try to settle your unsecured debts with a debt settlement company. Have you tried Superior Debt? superiordebtrelief.com may be able to help...worth a shot I think.
