To Whom It May Concern:
In lieu of your blatant disregard for the laws of the State of Alabama, I am offering Quikpayday the opportunity to settle with me,
legislature.state.al.us/SearchableInstruments/2003RS/Bills/HB178.htm
On the matter of the renewal and/or rollover fee in question, please read the following:
legislature.state.al.us/CodeofAlabama/1975/5-18A-12.htm
In reviewing my bank statements since May 2005 , I have paid over $2,460.00 in interest, fees, and principal on approximately $2000.00 in loans. The over $2,460.00 total of the interest, fees, and principal paid on eight loans of $2000.00 are excessive and in violation of Alabama code. Thus, I am expecting Quikpayday to mark the account under the name of Stephanie ***** ‘paid in full’. At no time will Quikpayday, any representative, parent company, subsidiary, or affiliate of Quikpayday, place any derogatory mark on my credit report with any credit bureau, nor any other check writing database, such as Teletrack or an equivalent database.
If Quikpayday does not abide to the settlement conditions stated above, I will have no choice but to file a civil suit against Quikpayday for the monetary damages that I am entitled to per Alabama, and all legal fees that I acquire during the course of such a civil suit. I will also formally complain to, and request that the Attorney General of Alabama, Troy King, file criminal charges against Quikpayday for its illegal lending practices to the consumers within the State of Alabama.
All correspondence as of today May 2, 2006, shall be in written form either through the email address, email address removed as per forum rules - Mike, or via The United States Postal Service.
Please acknowledge receipt of this letter, and acknowledge acceptance of, and willingness to adhere to the settlement described above, in writing, within 24 hours of receipt. If I do not receive this acknowledgement within 24 hours, I will begin the legal proceedings described above.
Sincerely,
Keep your fingers crossed guys....I'll let you know. It just goes to show you that being greedy will really piss people off. If they would have accepted the proposal they would be getting my money, now it will almost have to be overmy dead body. ****Side note, after the first email I received one back from Jamison, they had taken $100.00 off the balance due...is this common? What kinda crap is that?
It's very common for them to make offers on what you owe them.
It's very common for them to make offers on what you owe them. You may have to send this letter more than once, Tammy and I both sent it multiple times before we ever got any response.
Quick Payday called me at work today and the guy sounded very so
Quick Payday called me at work today and the guy sounded very soft this time. I immediately asked him why they did not accept the proposal from CCCS/MMI and asked him if he knew they committed a crime in my state by not being licensed. This was the first time I saw a payday lender beg like a door-to-door salesman.
He first tried to make me feel bad by saying "but you admit you took money from us". I quickly replied the contract is void and uncollectible in the state of AZ according to AZ's statutes. Then he started begging me to pay them back just the principle and I told him any offers must be sent to me in writing by US mail.
I know the offer is bullcrap because they never sent me any settlement deals in writing before. They just talk about it on the phone. I also told him that I have already filed complaints with AZ's AG and Dept of Financial Instituitions.

You can check with your department/division of financial insitut
You can check with your department/division of financial insitutions or bank commissioner's office in your state. You should be able to google this by your state name and it will give you more info on their website.
