You must get the latest copy of your statement from HSBC and see if the payments have been posted in your account. I heard Tammy saying in other thread that HSBC didn't post her payments. This is wrong, HSBC is trying to hurt your credit negatively.
You must get the actual status of your accounts with HSBC. Request T&C to get the latest statement about your account.

HSBC calls from 1-800-684-8429 & 800-359-2274. it's 3:58 pm my time. And already they have called me 37 times today!!! Sure I have an account with them. And I pay my account on time. I'm not a child and I don't need anyone calling to remind me to pay my bill. When they ask to verify my social, dob, mom's maiden name, that's where I draw the line. The calls have been coming for over three weeks. And they never miss a day. Can you believe they had the nerve to send me a new credit card in the mail w/ a $6000.00 line of credit. I called to cancel the card and that's when my problems began...37 calls a day is ridiculous. It's down right bother some. Let's not talk about the emails they send me on a daily basis to remind me to activate my new credit card. No, thank you. I have advised them on several different occasions to close the account. They say okay but the calls keep coming. And I have stopped answering the calls...I love the way Joe handled them. I'll try that the next time they call. Good luck to everyone.

Synnamon, that alone is at least violations of ???? 1692 d and ???? 1692 d(5) of the fdcpa. You are right about the card, they would just transfer money they say you owe to it. I'd think about suing them if I were you.

it's a legal collection firm...once a debt is past collections, companies turn it over to lawyers to attempt to collect the debt or sue if needed
HSBC Calls
Do like I do, as soon as i see the phone number appear on my caller id on my cellphone i simply hit ignore and the call goes straight to voicemail, these people never leave a message so u don't have to worry about using any cellphone mintues. I figure eventually they will stop calling. They were calling my home phone line nonstop daily and i finally answered and told them the person they were looking for does not belong at this phone number and they stop calling my home phone and have since started calling my cellphone. :roll:

no, lawstudent, this isnt a debt collector. HSBC is the original creditor, and the FDCPA doesnt apply to OC's. No lawsuit there.

This is incorrect on two counts.
First, the law is clear that the provisions it contains are ONLY the law when it comes to third party debt collectors, and not first-party, or original, creditors.
Second, the FDCPA does not allow you to sue for "$1000 per call". The FDCPA only allows a maximum of $1000 TOTAL for statutory damages, no matter how many times someone calls you.
Before you file a lawsuit like this, do the homework, youre going to get laughed out of court with this if you dont.

...or you can create a "Contact" in your cell's phonebook, name it "Debt Collectors" (or something similar), program every 888, 800, and 866 number that they might use, and then set that contact's "custom ringtone" to "Silent" or "No Ring"! THAT'S IT!!....their calls will never bother you again since you don't even know their calling!
(of course, you will most likely have to update the "Contact" with new numbers when they change the number they're using or they sell the debt to another collector)
