When a credit card account has been charged off and sold several times what do they need to show to prove you owe the debt? I received a notice from an attorney's office in regards to an account, I had previously received something from a bill collector I asked for validation and never heard back. Now several years later I get this. Can they just give the name of the original creditor? Is that enough to prove I owe the amount neither my husband nor myself have any knowledge of this account can we request copies of statements and copies of what was charged and who signed for it? What should we do? thanks gloria

Hi Gloria

If there is a past unknown account, this is the natural feeling that you should have in order to make sure that the company is making genuine collections. There are federal laws to back up in this case. Ask for a debt validation from the company so that you get the accurate picture of the account. Have a look at this page. You have the rights to request the following information from the attorney mentioned in the page below:

Also make sure that once the account has been validated and after you found it to be correct, check the SOL period of that account as per the laws in your state. Charged off debts usually go out of the SOL period depending upon the date of last activity on the account. If you have not paid anything within the stated timeframe, you can legally refuse payment.

If any type of payment activity is done again, you might come under the SOL timeframe and the company will enforce legal actions if payment is not done later.
