Need Help With Federal Communications Law

A few months ago it was posted the section of the US Code that dealt with harassing calls to phones and cell phones. (This is not to be confused with the fdcpa).. I have been looking all over and I can not longer find it. Does anybody happen to know which law this is?? I want to say it was in Charter 15 of th US Code ( 15 USC).. any help is greatly appreciated.... Thanks!

I believe you are referring to U.S. Code section 223 (a) (1) (B) which states that:

U.S. Code section 223 (a) (1) (B) imposes criminal liability on anyone who places a "telephone call, whether or not conversation ensues, without disclosing his identity and with intent to annoy, abuse, threaten, or harass any person at the called number; (C) makes or causes the telephone of another repeatedly or continuously to ring, with intent to harass any person at the called number; or (D) makes repeated telephone calls, during which conversation ensues, solely to harass any person at the called number.

Thanks Clay,

My personal view is not to let anyone harass you over the phone. Every person has his/her legal rights under the federal law and there are some additional rights under the state law as well. These rights must be used so that proper actions can be taken in order to stop such assaults.

A person must act quickly if he/she is being victimized and take the correct steps to protect the legal rights. If you are waiting for too long, there is a chance that you are compromising with your rights.

A cease and desist letter in this case would have no effect,as this is the Gas Company (Nicor Gas) I am dealing with. I have a first name, but they refuse to release full names, titles or phone numbers. I am filing complaints with the Illinois Attorney General (violations of this Federal code as well as ILCS 815 305/1 Telephone Auto Dialers act; Illinois Commerce Commission as well as the FTC, FCC and DOE. Maybe even BBB though I know that would be essentially pointless.

the law is the law. Equal Justice. I also highly doubt that the Gas company is trying to collect the money. They sold the debt to a collections company. No matter who it is, if they are trying to collect a debt thaty have to give you certain information that you request.

The FTC is a good avenue to pursue.

I used the BBB once to mediate with a company that was a Member of the BBB.

The company did not even bother to show up and I was awarded the refund. After trying to collect the BBB re-opened the case and I cannot even get a reply on the matter from the BBB, the Mediation, or the company I was mediating against. This was a $1000.00 dollar award and I got squat and a dial tone.

Clay,I don't care if it is the gas company or the president,18 times is harassment! I would certainly complain to a supervisor and keep documenting the calls and from whom. It's only 20 days late? What do they do if you are 30 or 45 days late-kill you :!: :lol: Hang in there and stand up for what is right...Karen
