2 agencies trying to collect same debt

my grandmother is getting credit agency notices. We have 1 from MRS and 1 from Creditors Interchange for the same debt (Citibank). They both came this week. Can 2 agencies try to collect the same bill? My gran became very ill 2 years ago, is now in nursing home and has no assets. Should I follow same-validation for these or anything elso that comes in? She has nothing for them to get.


Don't forget to send out validation letters to both CAs. Follow Tammy's point about contacting Citibank to see if you can find out which CA has valid claim to collect on the debt.

Does anyone know if Citibank keeps ownership of their accounts -- Cap1 does.

Regardless, if both CAs come back with validation and you've found out which is which from Citibank, write the offender CA a C&D letter and if they violate sue them for all legally allowed violations...they could end up paying off the debt for you through their violations.

Follow the advice given by others. You can also take one additional step by disputing the item with the credit bureau reporting it. Highlight the item requesting for investigation. Two collection agencies cannot collect the same debt at the same time and report in the credit file. They might have the accounts one at a time (if they have it in legal terms). Send your letter through certified mail with return receipt requested. Keep copies documented in a file.

Also, check the SOL period before making any payment on the account. Most of the states have the SOL period of 4 years. If no payment activity is done within this period, the debt is out of the statutes. You must check the laws in your state before deciding on this factor.

I need some advise. I recieved a student loan from Ed fund. The school that i went to defrauded me. my mother-n-law and i went to the same school for same the time period. my mother-n-law's student loan was paid by workers comp. at a cost of $4,500.00. The school told me I did not qualify for a PELL grant, so they got me loans (which i was told they were grants not loans ), between to lenders I have found out that I was charged a total of $16,000.00. Sallie Mae one of the lenders wrote the loan off and has never come after me. The other lender ED Fund is coming after me and has seized my husbands and my stimulus check. I was told by ED Fund everything will be taken from me; wage ganishment, future tax returns, etc. The thing is my husband is on permanent disability for over 7 yrs, I am now on my 3rd yrs of disablity and we recieve only my husbands SSI income. The thing is ED Fund is taking everything from me and they have also sold the debt to a debt collector who is calling me day and night harrassing me at all hours. If ED Fund has already liened every source of future income, how can a collection agency that ED Fund sold the debt to collect the same debt? What can i do?

I had a large account with Wamu, Wamu was sold to Chase.

I made a settlement with Chase and I have not missed any payments and I have held up all my end of the bargain.

Two months ago a collector Creditor interchange started harassing me for the same debt and the same original amount.

I informed them it was a mistake or had to be for we settled this account and was still paying for it. They harassed us to no end until we sent out the second cease and desist letter. We contacted Chase and told them repeatedly what was going on. They said that it was a clerical error and that this account was accidentally sold wile it was in settlement and that they would have it bought back and this whole thing taken care of with in 30 days, They did apologize, said it was a clerical error of miss coding and admitted it was their fault and simply a clerical error and not only did it happen to us but many other accounts and that they would have it fixed in that time frame.

Now another company is sending the same thing for the same account. Can two, now three companies collect a debt wile it is in settlement and still receiving settlement payments?

Our last payment on this settlement is due on July 24th 2009 and the settlement should be complete.

What do we do? Please help, this is beyond ridiculous and to be blunt it seems illegal! Should we sue?

There are two law offices trying to collect on the same account from me. One of them got this account in November of 2008, the other company was sold the paper in March of 2009. I am making payments thru the 1st company now the 2nd company has served me papers to come to court, i explained to the 2nd company that we we're paying and they continued to call. This was a Bank of america account who sold this to an agency, please tell me what can be done in reference to this, i have been harrassed, and embarressed with officers coming to my home about something i had already handled.
