I had a company levy my bank account and there was not enough money so now they are threatning to garnish my wages. Is this legal?

First of all, it is against the federal laws to threaten a judgment on any individual. You must try to negotiate with the company with your paperwork in hand.

A company has to file a case with the attorney and a summon will be sent to you before the judgment takes place. You must show your appearance in the court with all the proof. Explain the situation to the judge so that he can work out arrangements for you.

Meanwhile, it will be worth a try if you can settle the matter outside the court. Have a lawyer from your side to back up your case. You should be employed before a judgment is awarded to you and it should not be more than 25% of your disposable income. Talk to your lawyer for a sound knowledge on this issue.
