well,as you guys know---I have been 'round and 'round for the past year with Dell financial, Wells fargo AND their collection agencies. most of you know, its been a real headache for me.
Dell has given all of my husbands accounts to Oxford management. I have went round and round with them on validation and also over my MANY letters to them demanding that they stop calling my home. They have ignored me over and over again and have called me on a daily basis for months now. I never got the validation, but I certainly got more than my share of phone calls---sometimes twice a day-seven days a week. Legally, on a regular basis, that might not be alot, but it is when they're NOT SUPPOSE to be calling me at all!!!

I joined a debt consolidation group and added all of the Dell accounts and wells fargo onto it--along with my HFC account (that is higher today than it was 5 years ago when I first took the loan out and I've done nothing but pay it every month). The consolidation group (freedom point), sent out the proposal letters and told them when I would be sending the first payment. and the first payment was sent out to them. since then, Oxford is NOW calling four times a day!!!!! what the heck????
They're suppose to be contacting freedom point if they have a problem with the offer. but they are
harrassing me BIG TIME.

For a while, I has playing hard ball with them and not budging an inch until I received validation. they never gave it to me, but I started thinking that I needed to be in a safer place and should try to make an effort as far as getting this settled. So I joined debt consolidation. Now they're harrassing me more!!!! I was afraid of this. To be honest. I think I could have fought this and maybe even got out of paying them...but I was taking a gamble and it wasn't a place I wanted to put myself. I never denied that the debts were ours. And I had to do all the leg work to get these debts validated by the orginal creditor-myself-since Oxford was refusing. Now that I got the validation, I wanted to move in a forward direction. And put my mind at ease once and for all. Now I get this in return. As if they're saying they have me where they want me now.

AND NOW ITS TIME FOR ME TO GET NASTY!!!!

The tail of a dog can never be kept straight. And so are these scumbags who can never learn to be in their decent behavior. Have you thought of filing a case against the collectors? You can assemble proof by recording the phone calls, collect the copies of cease and desist letters sent to restrict the phone calls. Even after that, if they come on a disgusting note, you have a case here and will get compensated up to the extent of damages. You just have to think of filing a lawsuit from this point on. Keep in touch with Freedom Point and insist them to keep the company away from you.

thanks curlycarl!! I have contacted freedom point and they told me that if I have sent oxford a cease and desist letter and yet they continue to call, to report them to the FTC or my state attorney generals office for violating the fair debt collection practice. and I intend to do so. I am just sick and tired of being sick and tired with this situation. thanks again. shirley

Hi Shirley

You can start recording the phone calls also for making your legal move stronger. Check the laws in your state before you attach a recording device. I know collectors come in the best of their behavior if they are dealing with an informed consumer. You are aware of your legal rights and will just have to apply it in the right place.

Have you sent cease and desist letters before to Oxford via certified mail with return receipt requested? It sounds like you have and you are a smart cookie. If they have continued to call without validating the debt, that this is a clear violation of the fdcpa laws. The federal trade commission works primarily with third party collectors such as these so I would file a complaint against them if all the paper work is in order.

I'm working with a debt settlement company right now myself and I have to report all the calls to them. They provided me with a creditor call sheet. They don't want to act too soon because then they said I would really get harassed. I know that you are trying to do the right thing and getting no results. Keep your head held high girl :D

GO GET EM, Shirley!! They are breaking the law, do NOT let them get away with it. Take a look at naca dot net to find a lawyer that specializes in fdcpa violations and give one a call or an e-mail! Trust me, it can't hurt to try, and since this is a blatant violation, you might as well take them to court on it (which probably won't happen, they will most likely settle out of court for a good chunk of money plus your lawyer's fees).
