Things I know now that I wish I knew then.
Wolpoff & A out of MD.
Sent me a letter "intent to sue"
I sent them a check.
My bank is listing this as a debit.
Would they actually take the info on the check and direct debit the account?
This is my worry for the day.
It will be something else tomorrow.
I have to deal with them and NCO and Cavalry.
Many, many more questions just no time right now.

There are some places that will do the check as an electronic debit, instead of a paper check.
Macy's does that...But I just go into the store and pay cash..

You have come to the right place here. Do not worry much. We will try to help you out in all possible ways. Talk to your bank and explain your problem. They will not allow the company to debit the money from your account.
In the meantime, you can work out some payment arrangement with the credit company. If you are unable to do, I will suggest you to register here. One of the consultants will be calling you shortly for a free counseling. He will do the needful negotiations with your creditors. Don't feel tensed. Everything will work out nicely.

State law governs whether they can convert the paper check into an eft or not without your permission. If they converted it illegally, you can demand that the bank back out the transaction and get the paper check back, but they're not going to want to do that.
Btw, if W&A do sue you and get a judgment, the first thing they'll do is garnish that bank account that you so considerately gave them the account number for.

also, hopefully someone can confirm or correct me if I am wrong, but I believe under a new federal law enacted last year, their Bank (not them) can also opt to electronically present the check for payment. IN this case there would be no paper check presented, nor returned to you after the "check" was paid.. I think this was part of the CHECK 21 legislation.
I noticed that Wal-mart now electronically debits your account if you pay by check (this started last Monday), also HSBC Retail Services had a notice on my statement this month that upon receipt of a check for payment, they will process the check electronically as a EFT, and the original check will not be returned. This is rapidly becoming a fact of life. The days of floating a check a day or two until payday are rapidly coming to an end.
