I called an attorney and he asked me my balances on my card and then he told me he don't see them garnishing my wages, I was a waste of their time...he said they can try to get a judgment, but if I am enrolled into the program then he said the chances were slim to none.

Jedi ----YOUR AWESOME girl....basically the attorney told me EVERYTHING my debt settlement company and this forum has told me.

I feel MUCH better.

I was beginning to think each company had their line of story to feed me and I was wanting to get some sort of second opinion.....You all are the greatest. I am happy you are here to help others.

Hi ljclark1

Be educated of the laws in your state. In OK, the debt goes out of the SOL after 3 years from the date you last paid on the account.

Have you included the account in the program for which you are confirming the SOL? If a payment is done, I fear it might have come within the SOL.

The wages cannot be garnished if the debt is past the statutes. So, you must confirm this portion before making your decisions.

Gretchin,

I have stopped paying on my accounts back in 10/2005. BECAUSE I enrolled in the settlement program, not consolidation program. I have no judgements against me as of yet, that I am aware of. JUST THREATENING CALLS.

I was inquiring about SOL's for when I am finished with my settlement program, incase old companies are bought out by new ones and they tried to sue me again.

Linda,

After you finish the program, the company needs to send you in writing with "paid" status. They must also update your file with the bureaus. This will prove that the accounts have been fully paid and you owe nothing towards them.

You must take actions against the threatening calls. Start recording them for your legal proof with dates and time. Present it to your lawyer so that he can file charges on the company.
