Think I'm going to cancel with T&C
Date: Thu, 05/18/2006 - 09:04
I started out with several PDLs enrolled in my program a few weeks back. Worldwide Cash accepted an arrangement and ameriloan agreed to work with them (nothing has ever been finalized, though). That's the only ones. Cash Advance Now settled w/me for $100. Cash Doctors, Premier Processing, One Step Cash, and GW Financial all wrote off my balances.
Platinum B went to collections, but was pulled back yesterday when I complained about their illegal collection tactics. They will only work with me directly. Ameriloan has notified me they have received "the letter" and are deciding how to proceed -- I am thinking they will zero out my balance too. WWCN has already said they would accept $20/month from me directly if I decide to not go with T&C.
So...I have not made any payments to T&C because my contracted payment amount kept changing down as PDLs dropped like flies from my account. I am wondering if they will refund the $155 fee to me since I am pulling out without actually making any payments to them. I don't want to eat the money, but don't think I need their services any longer. What do you think?

I think that you are doing more for yourself than a debt consolidation company could ever do for you. I have had several friends use Debt Consolidation in the past and have expressed the same opinion which you are expressing right now.
Why should you pay someone else to do what you yourself are empowered to do? If they decline to issue you a refund, then they are wrong in doing so (my opinion) and you should insist on it.

Wendy,
Good luck! I did everything on my own, and it worked out great for me. Everyone's situation is different.

Yeah...I'm calling them after work to let them know it isn't worth it for me to continue with them. Worldwide Cash is letting me pay them the same $20 that T&C would for now, with the understanding that I will up my payment down the road. I am fine with that as I want to pay them off as soon as I get a couple others that are in settlement paid off this Summer.
Just heard from ameriloan...they had wanted T&C to pay them $300 + $90 finance charge + $30 NSF fee. After receiving the letter, they agreed to apply my $90 payment toward the $300 principle only and settle for $210. They wouldn't zero out my balance, but agreed to $50 monthly payments starting June 16th.
that's great! Yeah, but definitely let us know if T&C agrees to

I too thought about....
I also thought about not going through a settlement company with my 8 credit cards....I thought I could just save up the 400.00 monthly and settle myself (and the settlement company told me that I could indeed do that myself...however there was a small catch) The settlement company has professionals and trained people working for them to deal with creditors and CA's. The told me that Creditors working one on one with me would be more difficult for me, because they would want to settle for the closest amount that they could to the original amount of balance.
The settlement company gathers several accts at the same time for one credit card and then offers them an unbeatable figure and that is how they get them to settle easily for 50% of original bill. They explained it like this: a creditor is more likely to settle with twenty people at one time for 50% rather than one person at 50%.
I don't know if I explained that correctly, but I sure understand what I am trying to say.... LOL.

Caveat: I'm sure T&C is a great company -- I've read so many positive testimonials here about how much they have helped many of you get out from under these PDLs. I PERSONALLY was not impressed with the efficiency of the way they handled my program. The rude customer service person I spoke with today didn't impress me much either!
-------------------
So...called T&C on the way home yesterday to cancel. The person I spoke with said that was fine, but that I would forfeit my $155 retainer fee b/c I didn't successfully complete their program. I told her there was no longer a program to complete b/c all of my creditors except for ONE never came onboard -- and that it didn't make sense to use them to pay off only Worldwide Cash.
The girl became very rude at that point and told me that the retainer fee was on behalf of all the work they had done on my behalf thus far. I thought they were a non-profit company?
I bit my tongue and calmly pointed out the following facts to her: (1) I sent a letter ("the letter" in board terms) to my creditors simultaneously with retaining T&C four weeks ago. Based on this letter, the majority of my creditors zero'd out my balance. (2) Four weeks after retaining T&C, the only set proposal in place was with Worldwide Cash. They had not reached final agreement with ameriloan and had not even contacted them in nearly two weeks per her admission.
BTW...Ameriloan told me yesterday that they never would have accepted the $20 monthly payment T&C stated in my original contract.
(3) They made one call early last week to the agency that was handling my Platinum B account, but were simply waiting for them to call back. They had not followed up once b/c I asked the girl point blank. I told her I got the original creditor to take the account back -- but they would only accept payments from me directly, and not over an extended amount of time.
I said that based on this, I felt that I deserved my money back because I did more to advocate for myself in four weeks than they did. They did some work on my behalf, but they did not seem to have a sense of urgency to get all proposals in place. I told her I understand they are busy and have a lot of clients -- but that a month should have been WAY sufficient to get everything in order.
Granted, I never sent in my first regular payment. That is only b/c my creditors kept dropping like flies, so the amount kept changing. I was on a bi-weekly payment schedule. I also received a new updated contract to sign in the mail last Friday. As an attorney, to me that means the old contract is void and the new one isn't valid until I sign.
I was calm even though this girl was rude (not good customer service IMHO), pointed out my reasons why I thought I should get my money back, etc. The girl told me I needed to FAX/mail a letter to their Review Board -- then she hung up on me. Nice. Guess she didn't think she had to be courteous to me since I am no longer a client ;).

I agree with this. They could do no good to me too. They could not convince my creditors to work with them. Later I registered with this site and the counseling session really helped me. T C was quite slow too.

Wendy I'm sorry to hear about your bad experience with T&C, I have had nothing but good experiences. As for the rude girl, I do know who you are talking about and believe it or she is a supervisor. I know I've complained about her several times and so have others...the only solution I have for her is that now she does not talk to me so I either talk to one specific person or no one. I think they are a great company who has helped a lot of us out here that need it. I'm happy for you that you got all of your pdl's forgiven or worked out a payment arrangement on your own.

Your approach to the lender gave you the desired results. Remember, you must stick to your payments so that the company does not change up their mind. Do you have something in writing about this proposal as a back up? It will be helpful

yes, they even e-mailed me our arrangement in writing. I was also able to make arrangements with onestepcash. as for the others..... no luck! I'm thinking of stopping payment with my bank on all ach debit entries from the other companies. Then they'll have to work with me. Right....

There is no set rule that the lenders must work with you. But if you show them your responsibility of clearing the account, some arrangements are offered by most companies. Try to explain your situation to your lenders before closing your checking account. If you are able to work out an arrangement, there won't be a need to close your account.

Wendy,
I worked with T &C for a few months and cancelled my program with them. I had better luck too working with my creditors on my own, payday loan companies. They seemed more willing to work with me. I had problems with payments being late through T &C which caused some nasty phone calls from the pdl companies. I made my payments on time with T & C but we could never come to an agreement on a regular payment. I still made huge weekly payments to get things taken care of. I finally decided to end my program and was told that I could not get my retainer fee back. I think I spoke to the same woman as you because she got very rude with me. She was the only person that I dealt with there that was rude. No, they are not a non profit company. I sent a nasty fax stating how many people I had referred to them and that most of my creditors zeroed out my balances. I did get my retainer fee back so I would be persistent on that issue. I'm not sure how it works since you didn't make any regular payments to them. They did help me out during a difficult time and I'm grateful for that.
