hello. a while back I wrote a check at CVS for $120.00. As usual stuff happened, and I closed my account and the check had been returned to them. They sent me a bill asking for payment, saying they would issue a Warrant if they don't get payment. Does this mean I could be arrested for that amount?


Technically, that is considered writing a bad check since you wrote the check, then closed the account before it was paid. However, have you tried calling them and explaining your situation and asking for payment options or something? I know when I was having difficulties with PDL's and I had to shut my bank account down, I had an outstanding check to the BMV for my car tags that came back NSF. I called and told them my situation and they were REALLY nice about it and allowd me some time to get things in order and make payment. They even waived the NSF fee they were going to charge me.

I don't know if they would arrest you for $120.00 or not. It's such a small amount that most places would right it off. Even if they were to arrest you, in most states, it would only be a misdemeanor. I would try to get is straightened out before it gets to that point. However, if they are already stating that they will issue a warrant, they probably intend to do so if you don't pay and make no attempts to pay.

Depends on your state, But generally I would say yes. IF AND ONLY IF they can prove check fraud or embezzlement or both. If you refuse to pay then they have all the proof they need. Pay it in full ASAP if you can. Also, I would send them a letter saying specifically that I DO NOT refuse to pay, but because of some financial difficulty would like to send in partial payments. Maybe they'll work with you.

Yes, definately make sure that if you do set up payment arrangements, you get them in writing (whether it be email, fax or snail mail) so that you have proof that you set up the payment arrangements in case the warrant should accidentally get issued or something to that effect. Always make sure you cover your A$$!! :)

actually that charge in that amount would be considered "uttering and writing". It's a small amount to prosecute for, but they could. I would think it would be a bench warrant, which would mean that they wouldn't come looking for you, but if you got pulled over you could go to jail. I don't think that'll happen...really, it costs them money to do this stuff, and I really think if you just call and make arrangements they'll work with you. I'd definitely take everyone else's advice and pay it off as soon as you can, though.
