I owe charge cards and other things that I order from catalogs. I was making my payments monthly and then a bad thing happen, I became disabled and was unable to make these payments. I wrote each and everyone a letter telling them my problem and would be unable to make anymore payments. The phone rings constantly now, from 7am until sometimes midnight. Is there anything that I can do to stop this. I have heard of a cease and desist letter but don't know how to write one. I understand after recieving one of these letters, that they can only contact you by mail. Is this true??
Any help would be greatly appreciated.
Thanks.

They are only allowed to call between the hours of 8am-9pm your time zone. Send them a cease and desist letter stating that as of todays date they are no longer allowed to contact you by phone. Tell them in the letter to only contact you by US mail from this point on. If they contact you again by phone they will be in violation of the fdcpa laws. Check out the ebooks section of the forum and I think there is a sample cease and desist letter for you to use.

Creditors are not legally required to follow the cease and desist clause set in the fdcpa. It is legally applicable on collection agencies only. But if you have put a written request to your creditor, they should honor it. Explain the situation over the phone and work out possible arrangements. This will help effectively in stopping the calls.
