Arrow Calling My Work

It is my understanding they will try to get any information about you that they can....I believe it is also illegal to release information regarding your status with any of your co/workers.
I a couple of weeks ago, I had a call from CA and they were NASTY. I told him that I was going to record the remaining conversation and he popped off, "well go right ahead and blah, blah, blah." I interupted and said, "Please hold while I prepare to do so..." He hung up on me.
Today, my secretary buzzed me and said, "it is investigator so and so..." I quickly recognized his name and to my surprise when I picked up, he had hung up. Maybe he thought I was turning on the recorder.
collection agencies pick information about you from all sources.
collection agencies pick information about you from all sources. They collect it in order to make their basis stronger and keep you within the reach. But under the federal laws, CAs are not allowed to discuss about your accounts with anyone else. If they discuss about your debt, it will be a violation of the fdcpa law and can result legal actions.
If you do not know the reason of this CA calling you, get the details from them in writing. Perhaps, they are trying to reach you with a valid reason or they might have mistaken you with someone else. So, I will definitely like to know the reason of their call. If they don't give any valid info, send a cease and desist letter to their mailing address and force them to stop contacting you. After the company has received your letter, they should not contact you further unless you have specified for written correspondence only.
Know your legal rights mentioned in the FDCPA9. This will help you in dealing with the CAs strongly without being intimidated.

What happens if you don't have any money to pursue a legal action suit against the creditor when they break these laws.
Because not having any money seems to be the reason I am enrolled in a debt settlement program to begin with.

The federal laws offer legal protection to the consumers from companies doing shady practices. Keep everything documented in a file that proves you are using the debt settlement program. Your credit file is the most important financial document. You must ensure that no company hits your file without valid reasons. You have the legal rights to dispute inaccurate information with the credit bureau. Besides, you must place your complaints at the FTC, BBB and the state attorney general office for investigating the companies doing shady practices. The authorities don't get into action with a single complaint. So, everyone going through similar problems should put their complaints and bring the authorities into quick action.

At this point, they are breaking the law. You told them on the phone that the person they were trying to reach is not allowed to receive these calls at work. The very minute that happens, they have been properly notified of this. Thats what the law requires. And, once they are told this, they are required by federal law to stop calling you at work.
I would send them a letter telling them that they are in repeated direct violation of the Fair Debt Collection Practices Act, because they have been told that you are not allowed to take calls at work, yet they still call anyways. I would tell them that any further communication is to be done by mail, or you will be forced to sue them for their fdcpa violations.
Send that letter certified mail, return receipt requested, and when the green receipt card comes in the mail, save that card, along with a copy of the letter you sent. Then, the next time they call, you will have all the legal proof you need to actually file the suit against them.
But Gretchin is right--request debt validation too. You need to see why they are calling before you decide that they shouldnt be contacting you at all. they could have a legitimate debt of yours. Or, they could be full of it. You need to find out which one it is, and youre much better off finding out now as opposed to later.

I agree that they have broken the law. The fdcpa says if they know that you cannot receive calls at work they cannot call.
There is really no information they can get from your HR to use against you. They know you work there...that is as good as employment verification. Calling your HR would basically be harrassment.

Even though this is an old thread revived, I find it very interesting and informative. It worries me to some degree as I am also dealing with Arrow, I suppose their next move will be calling me at work. I just hope I am up to coping with it, if and when it happens. :?

I am a small employer..since my time of being on this wonderful site..
it seems that in past few months..Ca's have "stepped-up" their game and ARE calling repeatedly at work asking for people who work here...
are extremely rude and pushy to secretaries..if I am there and answer phone..letting them know employee has a job to do and is not allowed to accept personal phone calls..some even state "It's regarding a debt that hasn't been paid"...and they call over and over...it's almost like because they haven't been paid yet..they do everything they can to harass and get these people fired..they don't let up....I know this for a fact..they should not be able to call you at work NEVER EVER..just my opinion...but ..hello! if you have a job and owe someone money..and they harass your employers and people you work for...you might be let go and looked down upon..and this I think is their leverage they think they can keep putting out there..I say

socks--the next time one of them tells you "this is about an unpaid debt", you need to fire right back. You should reply, "well, by telling me that information, you just violated the fdcpa's statute regarding revealing private information to a third party. You're also violating it by your repeated calling when I informed you that the person youre looking for cannot receive these calls at work. I would suggest you leave it at that and find another way to contact them, or face the music when you get sued for these violations of federal law."
Then, simply hang up the phone. Put it back on the debt collector that cannot follow the law and doesnt listen to you when you tell them not to call there.

guest I didn't understand any of this until I found the sight and now that is why I am so rude to these people who pull these stunts..I just really know how rude they are with me..(not the person who supposedly owes them money)..whatever happened to R_E_S_P_E_C_T?..when they throw that out the window from the get-go..it's no wonder these people aren't dealing with them at all!

Hey Socks...
How would you really like to do these CAs one in the eye?
Next time one of them calls looking for your employee, log the call and any violations in it. Just like you'd do if they were calling harrassing you. Then turn the info over to your employee, with a copy of fdcpa and a link to this site. A few well-placed lawsuits, and the CA might just be singin' a different tune.
Respect from a CA? Don't kid yourself. They generally don't care about anything but the money, and are willing to do almost anything to get it. I operate a little differently than most folks. They can give me respect, or I can take it. It's all the same to me.

thanks wulf....I really think I need to start logging as you have suggested....
I currently have two employees who are what I think being deluded with calls..it is a hassle and nuisance for me...I get pissed because callers are so rude.this in turn affects the way I treat others for a period of time...it is a viscous cycle and intrusion that needs to stop..you know what? I have better things to do than to field calls for collection agencies at work!..the next call is gonna get put on speaker phone and logged with a witness and someone is gonna pay...
thanks again Unc..
I have so many irons in the fire..sometimes common sense takes less time than the time I have myself wasted with these idiots!
Great!
UncleWulf!
I had one of those hand hitting my head, "Wow! I could have had a V-8!" moments!
Yours was a great idea! It can help educate the employee about their rights under the fdcpa (by giving a copy of said FDCPA) and it help them with backup if they do decide to sue the CA! It might also help, Socks, in knowing you might have turned the tables on these annoying CA's that keep calling and bugging you too. You might also go so far as to tell the employee about www.naca.net.
I know how you feel, though, Socks. Many years ago, I was a computer operator at a hospital here in Jax on the day shift. I received numerous calls throughout the day, from CA's, looking for a guy that worked night shift. He was only there from 11P to 7A. His home phone had been turned off, so the computer room was the only phone number they had for him.
And they used it!
Constantly!
I finally had to start getting rude with them too! I asked them how many times I had to tell them he worked the night shift, he's not here now, he'll never be here during the day! You're calling a place of business and I don't have time to keep answering your calls and telling you the same thing over and over again. One even went so far as to ask me to tell him, in the message I was to give him, that this was an important legal matter. I said, "Sure, I'll also let him know what an annoying butt-munch you are!" She hung up on me.
Well, I finally left there to go back to college anyway, so someone else had to deal with the constant calls at that point. I did hear the poor guy got fired for showing up drunk to work one night, though. I really felt bad for him, he obviously had other problems than debt management to worry about.
