I got a call from this woman that said that if i dont send the money they will arrest me yadda yadda yadda.. so my question is.. i dont have the amount she wants and i called the intial loaner and my account hass official been turned over to them.. cani send her what i do have or do i have to send what she is requesting?

Absolutely not, you will NOT get arrested. Defaulting on a loan is not a criminal matter. As a matter of fact, the woman who called you broke a federal law by threating you with an arrest. It is one of the most common stronghold tactics by the ruthless collectors. They are trying to scare you into making the payment you can not afford up front....it seems to be working since you got scared, right? So dont worry. :) You must send the letter requesting a debt vertification through a certifed mail and then go from there. Rest assured that you will not get arrested.

This is what I found in my research for debtor's rights.

* falsely claim that they work for a credit bureau;

* threaten to sue you if that is not legally possible; or

* make use of a false name.

as a collector they broke federal law and likely any state laws (if ohio has them) governing collection activities. I would immediately file a complaint with your state attorney general's office and proceed as sapphire suggests. you can find sample validation letters in the ebooks section of this site. They are free to use.

Yep,listen to Sapphire...

You can not get arrested...I hate it when they try to lie to people and get them all scared. I wish I could call them and pretend to be an attorney and chew them out left and right.

But then I would be stooping to their level of integrity huh...

Bergen boesch this lady is being investgate by texas law inforcement and she doesnt even care if she gets 15-20 yrs for stealing people info and becareful guys she not real. All she wants and her pers. Is your money!!!!!!!!!!!! Dont pay :twisted:

Bradley, be aware that more than one collection agency can attempt to collect on the SAME payday loan account. This has happened to me more than once. This is why it is imperative to demand that the collection agency provide validation of the debt they are attempting to collect. Don't ever give them your checking account information over the telephone. They must prove to YOUR satisfaction that they have the right to collect a debt, they CANNOT give you false time warnings (pay by 2 this afternoon or we will issue a warrant)...they CANNOT have you arrested! Please take heart that you are not alone in this situation, it has happened so many times you cannot believe it. Learn from my mistakes and make them validate before you pay them a cent!! I have a couple of payday loans out there and I have requested them to be paid off a couple of times and instead of them taking the money and paying off the loan they just keep on deducting the interest out of my checking account. I am thinking on closing my account and just paying them off by money order or bank check. But the problem I have is that I cannot afford to be bothered at my work. Any suggestions

I also had the crap scared out of me last April. This CA called Capitol Collections faxed an "offical" looking document to where I work. This document had the words Complaint for Warrant written at the top and it preceded to say that I would be apprehended at work or home if I did not pay what I owe. My heart was racing so fast I thought I was goingt o pass out. I sent them a letter stating that I could not pay the full amount, but that I was able to make payments. I got no response. I waited a month and sent them another letter, still no respone. I then found this website and it suggested that I send them a debt validation letter. I did this and I still have not received a response.
These people are so full of crap. I was so scared that I would be dragged out of work in cuffs.
What they did was just plain wrong and illegal. First of all they faxed this to me at work, where everyone pulls out the faxes. Second, they are threating me with arrest and third, they refuse to answer my letters. If I ever hear from them again, I will definitely be filing a complaint with the attorney general's office.

so im kinda in the same boat, when i lost my purse it had all my stuff in it, and i had to close out my account, and now they are turned over to supposably legal matters for internet fraud etc., when i asked to pay in installments she said no they do not make arrangments. i had the FTR Processing payday loan place threaten me to, and it scared the crap out of me, i actually moneygramed $267.50 to them so should i ask for documents?

The employees of PDLs will tell you anything to scare the heck out of you even if it is not correct, you are there "PREY". I am learning from a HOTLINE in KY that if you cant get help right away from a counselor Your best bet is to close your bank account and open somewhere else until you get help. PDLs are CIVIL matters NOT Criminal

Payday loan lenders should give you the itemized statement of your loan account if you request. No need to send them debt validation letter because it applies to collection agencies only.

Write a simple letter for your loan statement. The lender should give it to you without any questions. (Sometimes, it's so hard to get that)

Just wanted to be another person to reassure you that they CANNOT have you arrested!!!! They try to use the
"worthless check" or "internet fraud" thing and tell you that their client is going to sign an affidavit by noon if you don't have the money!! DON'T believe them!!!!! They are breaking the law and you do need to report them to the FTC. I did when a woman called me doing that!!!!! Scared me at first until i talked to my friend who is a paralegal!!! good luck and report that foolishness
