I received a call from e-processing today. They told me to get a lawyer because I couldn't pay the entire amount due TODAY. I offered to pay 1/2 by 6/30/06, but they wouldn't accept. Is there anything I can do to stop them from suing me? I don't want anyone to come to my job to serve me with papers. I am behind on paying this, but STUPID me, I had a bunch of payday loans out at one time, and I just didn't have the money to pay them. Now I can? Any thoughts anyone?


Try sending the check through mail and see if they accept it. If e-processing cashes your check, it will result no actions against you. Make sure that you send the check through certified mail with return receipt requested. You can also choose to send the money through money gram.

I assume the company will accept your proposal after they have your check in hand. In the rarest occasion, if they are not willing to work out any arrangement, your payment effort will be considered an important factor.

The company can file a case against a person if they intend to. But you should have your proof to explain your side of the story. Seeing your efforts, the judge will be interested in making decisions in your favor.

Sounds good, but I can't pay the 1/2 of the loan until the end of June. Perhaps I should send them a portion of that next week -- to show good faith?

Will they really send it to small claims (or wherever) and have a marshall come to my job?

No, I wouldn't even T-H-I-N-K about sending them my personal check. Besides, I can only send them $100.00 next week.
