Hi, welcome to the forums!
The SOL of limitation for Georgia varies by what type of debt it is. I have found a few of the items, and listed them below.
Quote:
Personal Injury: Professional negligence actions, including medical malpractice lawsuits, must be filed within 2 years. Fraud: 2 years. Libel / Slander / Defamation:1 year. Injury to Personal Property: 4 years. Product Liability: 2 years. Contracts: Written, 6 years; Oral, 4 years. |

When did you last pay towards the account? Check the date of last payment activity because the SOL in Georgia expires after 4 years on open accounts and after 6 years on written contracts.
Expiry of the SOL does not mean that you are not liable to pay the debt. Though no legal actions can be taken against you but it will be reported in your file as a negative remark and your credit will remain hurt because of this unpaid account.
If you are not going through a tough financial situation, consider paying this account and improve your credit. A paid account will reflect a good credit history than an unpaid account.

Miller..same thing happened to me about 10 years ago. I owed $1800 on my credit card, and when I got sick and couldn't pay they ended up garnishing my wages for $3800, that included court costs and interest...

SOL only gets renewed when you even make a small payment towards the account. Most companies insist to show some kind of activity either by a formal letter or by making threats. You need to be aware of your state laws before making decisions.
MILLERCDB, you are not legally obligated to pay the debt if you have not paid anything within 4 years after the date of last activity. Be careful because the company will try to get a partial payment and renew the SOL at this time. Ask the company to give you the details of the debt so that you are sure of them making legal collections. Later, you can send a letter explaining the expiry of SOL through certified mail.
erzeke1, did you get court orders before the wages were garnished? Besides, you will have to make some payment and renew the SOL for wage garnishment to take effect. I am sorry this thing happened with you. Clear all your queries now so that you do not make any such mistakes again.
Justme, Appreciate the advice, but that was a really long time
Justme,
Appreciate the advice, but that was a really long time ago, and aside from the pdl problems, I worked really hard to improve my credit since then and it's actually not too bad right now.
I did receive the court orders but it was out of state and I didn't show so they went ahead and garnished my wages..They took $350 out every two weeks til it was paid...Believe me, I'll never go through that again!
personal loan
I am in the state of georgia and I had a bill collector call my job. They said that I had a 500.00 personal loan and never repayed. This was back in 1997 and I can't really remember. What is your advice please and thanks....
Pet deposit
I paid a pet deposit in 2002 and used money orders. During an audit of the housing authority this year, they find no record of my payment and I can't find my receipts.
Can they come back and make me pay a second deposit?
