My husband had a collection from 8 years ago (from Providian) turned over to MCM. We finally got the money together to pay it off and he called MCM and was told it was turned over to some Visa company. He called them and they wont even take our full payment, they want us to pay half now and the rest later, interest free. I don't get it. We just want to pay it off. They also said they will send us a Visa card (which we don't want). Does this sound right? We've never had a harder time getting someone to take our money.


You need to be careful before sending your money. Please check the latest copy of your credit report and see if this account is reported in your file. I believe that it is past the seven years reporting time under the FCRA.

Once the account is removed from the file, you are under no obligation to pay the debt. However, a partial payment will re-enter this item for longer duration.

Verify the details of this debt thoroughly before you make a payment agreement. You might have heard that some company make collection attempts without proper documentation and do not report to the bureaus because of their unauthorized purpose.

I called them today trying to settle an offer of 50% that they say has expired, now they want an extra 1000.00 to settle the account. I can't talk to anyone they keep transfering me. They also keep adding interest to account that they bought, can they do that? I did not think they could.
We are trying so hard to get back on track and we just about got it and they are being difficult.
I don't think they can force an issue of a new credit card.

The credit company must mention in the original contract that the collection agency is allowed to add interests during further collections. Besides, the charges and fees should be within the permissible laws in your state. Get in touch with your local AG's office for more info. Check the SOL before you make a payment on this account. If the statutes have expired, they cannot legally force you to pay the debt. It will be your wish to pay the account and improve the credit after the SOL expires.
