WE are in serious debt....70,000 to be exact. I can no longer swing it. WE are behind in credit card payments beginning this month. I am terrified of when the phone's going to start ringing. I investigated a dmp only to find out the payment was even more than what we are paying now. Can't do it. What can happen to our home if we fall behind on credit cards? Our mortgage is always paind on time. Should we file bankruptcy?

of this 70k how much of it is yours, your partner, and how much is joint?

i am 12months late on credit card bills, it takes awhile before they start bothering you, you still have time ....I changed my phone number...told my husband we were getting too many telemarketing calls...that helped alot. whenever you have to call a creditor, hit *67 i think and that blocks them from getting your telephone number.

I'm in the same boat, 90k, in debt current on mortgage but 12 months late and in big trouble.

Terry

Trish---I would first register as a member with this site, you will receive some free debt counseling and they can steer you toward other debt consolidation programs and provide some information especially for your situation. There are undoubtedly many debt management programs out there, so don't believe what just one quoted you.

Trish, Don't worry about the calls from the credit card companies. I don't know how far behind you are but most companies won't charge the debt off until you are 120-180 days late. Some of them even have hardship programs that may be able to help you get by. Looking down the road if the credit card debt is charged off you may have to deal with junk debt buyers, but definitely don't talk to them except through written correspondence. Eventually it is possible that you could be sued and a lien attached to your home, but if you are only a month behind on your credit cards you still have several months, maybe even a year. You might even need to bite the bullet and talk to a lawyer about a chapter 13 bankruptcy where you can keep your assets and get things under control. If you have enough equity in your home or if you have good credit look into a debt consolidation loan at a good interest rate. Also most lawyers will give you a cheap consultation so it might be good to at least talk to an attorney and get their advice on your situation.

I would do anything to stay in my home. We have decided no matter what we can't pay, the mortgage comes first. You say you changed your phone number and told your husband you were getting too many solicitor calls? Did he buy that? You need to be open with him about all of this if you aren't already. Not communicating about this will only make is snowball. You both have to be on the same page about this if it's ever going to get better.
