Collection Agency calling at 9:45pm?

I have been getting calls from I.C. Systems, a collection agency that is trying to collect on a medical bill. They called at 9:45pm last week, despite the fact that I had already spoken with one of their reps the previous week and advised as to when I could send a payment. Is calling that late copasetic or what? They are not on the West coast, so the time difference excuse cannot be used.

I am so glad I found this site - I am glad to know that I'm not the only one struggling and at the end of my rope.

Putting the matter straight, debt collectors must not call after 9 PM. This is against the Fair Debt Collection Practices Act. Read more about the fdcpa and know your legal rights.

You must have a proof of this violation in order to make your legal approach stronger. Get a recording device and attach it to your phone. Check the laws in your state if you are allowed to do the recording secretly. Also, note down the dates and time of the calls done to you for discussing it with your attorney.

IC Systems is located in the State of Minnesota and does calls nationwide. My daughter used to work for them and they are not allowed to call after 9:00pm. It must have been a new person that didn't realize that.

Ignorance of the law is no excuse. IC Systems needs to train people better if they are new and do not know not to call. The law states they must abide by the time zone of the state they are calling to, not the state they are calling from. I would definitely document their calls and report it.

They called me once at 10:00 pm and I told them about it, they said that since they were in a different state and they go by their time. I told them that wasn't true. I have also been trying to get a debt validation letter and they say they sent it but I still haven't received it. I told them that until they can validate my debt I am not sending them a dime.

debt collectors CAN NOT call after 9pm. no excuses what so ever. they must abide by your time zone, not theirs. please document the calls and if at all possible have proof (can easily be retained if they are calling a cell phone number).

try sending them a c&d letter and let them know you will not tolerate their illegal practices. be sure and send certified w/ ret. rec. in case they chose to ignore this as well.

You might also want to complain to the attorney general's office in your state and their state as well.

Are debt collectors allowed to call on Sundays? I've been told yes and no so I'm not sure what to believe

They also cannot call if it is inconvenient for you. If you are having dinner, tell them "we have dinner and get the kids ready for bed from 5PM to 7PM, do not call during this time" and legally they are required to honor it. If you tell them that your religion requires you to not conduct business on a Sunday they must also honor that. Per FDCPA.

Sounds like you're just splitting hairs. If you live in the Central time zone and that's the contact number they have, then the assumption is that's where they are calling. The fact you were visiting SC is irrelevant.

CA's are NOT allowed to call before/after certain times. But.....they do anyway. Even if they are on the West Coast, and you live in the East Coast, they SHOULD know what area code they are calling!!..you would think!!LOL I have 'Caller ID' on my phone. If I don't recognize a number, I just don't answer the phone.

Yes, debt collectors are allowed to call on every day of the week including holidays during the timesframe of 8am to 9pm YOUR timeframe.
