So I got a call about some litigation naming me as a defendant on my voicemail. I was kinda shooken up because I really didnt know what it could be.

Tuens out it is Douglass Burgess calling about a credit card debt. I really didnt know who these people were, so I started to ask who they were, where they were located, and saying that I had not gotten anything from them. The lady got real defensive and wouldnt answer my questions, but started to ask me about the card. I told her I needed something in writing, but she replied that I didnt understand the situation. So I told her I wouldnt talk to her because I cant verify if she is who she says she is.

That was that.

So I search for the name, and get a hit at this site. It seems they are a collection agency. So then I call MBNA, and it seems the last payment I made was in 2001(opened in 98/99 i think), and that they had sold the account to Collect America with a blance of about $1500. So I dont know if Collect America sold it or what. I think the max on the card was $1000, the rest is interest or late fees I guess.

So... Im located in Texas. Is my SoL 4 years, or is it something else, depending on where MBNA is located? IS my best move at this point to send Collect America a DV, or call them to see if they sold my account to Douglass Burgess? What are the odds I will get a summons? The address Douglass Burgess mentioned is not the one I am currently at, Im about 20 miles from there now.

I would have made an account, but I cant find the "make an account" link, feel kinda dumb with that.

Thanks in advance for any help or suggestions.

Collect America could have sold it to Douglas and Burgess, or D&B could be a scam..So send them a DV and make them prove that you owe the money from them. They HAVE to prove it.

Send everything certified mail so you have proof. Make copies of EVERYTHING.

You should also contact Collect America and see if they still hold the account.
