Melissa, check the SOL period of this debt and confirm if you are under any legal obligation to pay the account. If the statutes have expired, you can legally refuse to pay anything.
One more thing, you can still make arrangements with BOA if they have not sold off the account to Frederick Hanna. At present, they are not accepting your proposal because of your delinquency. Assure them that you will be making the payments regularly and have problems dealing with the attorney. They might work out something for you. Has the collection agency validated your debt in writing?
collection
this is an actual law firm- believe it or not. You see you run up a credit card and the credit company will sell your debt to a "debt-buyer" that dbt buyer will start collections on the amount owed and about four or five different collection agencies later the debt buyer or the original creditor will hire someone like fred hanna to collect on THEIR BEHALF so like it or not they are not a collection agency.. and eventually, unless you die before they do, they will collect on behalf of sherman or discover or capital one whom ever you may not being paying.
SOL is typically 6 years from the Date of last payment. Write a letter to Fred Hanna himself and offer your money. Send it certified.

And Freddie Hannah IS a Debt Collector as defined by the fdcpa
Fredrick Hanna
YES..Fredrick Hanna will pursue garnishment and attempt to obtain funds in any way they can. Your wages can be garnished for up to 6 months at a time, at the 7th month Hanna has to submit a new garnishment order, in the meantime your wages are free from garnishment and it will give you time to call their office to try to set up something to avoid another garnishment. Try to pay whatever they will take before they do garnish your wages. Trust me, it has had me in the hole for over two years now. They have collected over 500.00 a month from me for the past two years from a debt owed by my ex-husband, since he dissappeared, they persued me....

fed ex tried for 3 days to deliver something from fredrick hanna. I was never home. Does anyone know what papers they are trying to send me. I am in a debt relief program. I did have a phone call a couple of months ago and they wanted money. Do you think I have it in my back pocket to send to them, I don't think so.

They are probaly trying to serve you with arbitration papers, court documents cannot be served by FedEx. If they tried three times FedEx will return them to the sender.
More than likely they will give up and try something different. That is what happened to me.
Never heard from them again.

And, according to Consumer Advocate Bud Hibbs ("http://budhibbs.com/collectorpages/hanna_frederick_j_assoc.htm"), they are one of the worst agencies out there, so please be careful. Document everything. They even apparently lie on affidavits....
And if it's Arbitration, *don't accept it*. See "http://www.arbitrationjustice.com/" It's heavily slanted toward the collector.
