I know I have seen the answer somewhere before in the forums,but can't find it.My question,can a CA who is collecting for a doctors office put a hold on your state income tax refund and keep it unless you pay them? I was thinking of contacting oc and talking with them,I have been making payments to CA,but unless I pay them in full by July 7,they will take my state refund.Thanks for your help...Karen


I don't think collection agencies can put a hold on your state income tax refund. If anything like this is to happen, the doctor's office will make the decision. You must contact the doctor's office and get the matter clarified. If you don't want to pay the CA, insist the doctor to accept payments directly from you.

Thanks guys. They(CA) sent me this form to either,pay in full today or sign over assignment to them to take my refund.If I pay before July 7,they will release my refund.I got my state refund and it is minus the amount they say I owe. I think I am going to call oc and talk to them at dr. office and see what is going on and see if I can work out something. Probably never will get the rest of my money from the state though...Karen

I called my Dr. office and turns out it is a state run office and they can take your income tax,I called State Treasurers office. Also if it is a State run office they have no statute of limitations. They are now saying my son who is on disability owes them 700 dollars from 2000.And worse yet,they say we are responsible,even if he's over 21 because we claimed him on income tax.What a rip-they were supposed to write off the charges that weren't covered. They put him on a limited pay plan because he had not gotten Disability yet,guess they decided to go back and charge full amount. The lady I talked too said they can go back as many years as they want too-always somethin'!...Karen

And I cannot imagine that they can take your taxes without going in front of a judge. Don't trust the words of others....research it yourself!

It sounds like the deciding factoor was the doctors office/ Hospital was a a state facility, and that debt to the state have no statute of limitations. I know if you owe money to a federal agency, they can take money out of your tax refunds etc without going in front of a judge, so its not unreasonable to think a state debt could be handled the same way.
Had it been a private doctor,then normal collections, SOL and regulation would certainly apply.

Thanks,Polly for the info. I called about my state refund,haven't gotten it yet and the Stato Treasury department person said,yes, there is a hold on your refund from blah,blah doctors. I have to call back to doctors office tomorrow to check on my son's stuff. I thought you had to go through something legal too,I offered to give them a check by phone but she wants a money order. I said,if you are going to take my refund check in a few days,I don't have enough time to get one to you,so she says,we\ll jusst take your refund. As far as my son's bills,I don't think she is right about us being responsible for his bills just because we claimed him on tax returns. If that is so,are we responsible for my elderly mother's bills too since we claim her?! I'm calling them tomorrow to see what other hell she comes up with :D ...Karen

You are right,Clay,if it had been a regular doector,it would have been different. Plus my doctor is moving in with another group and hospital and taking his patients,so I don't think they are too happy with that. I still don't understand how my husband and I are responsible for my adult sons bill,just because they said we claimed him on our income tax. I have called and left several messages for that lady I talked to,she was supposed to check that out and gfive me a reason,but she never returned my calls. Guess I'll wait to see what they do. Hopefully they found out they were wrong about that!...Karen

Well, actually it makes sense. If you are claiming your son as a Dependant on your taxes, then your are saying he relies on you to provide food, shelter, medical care and other essentials for him so if you claim the tax credit for taking care of him, then they probably hold responsible for paying those associated bills.

Yeah,guess you're right,Clay. He is on disability and gets a disability check and is on Medicare,but that only goes so far.He doesn't make enough to file tax,so we claim him.Wonder why they didn't take our whole tax refund,only for mine,but they didn't take the rest out for my son's debts.I told them he was on disabliity and could we work a payment plan out,but they said they would call me back after they did some more checking on his stuff. They weren't going to give me info on it because he is an adult,and I said if you are making me responsible for the bill,you better give me the info!They were still kinda dancing around that issue too. Guess I'll call Monday again and see what payments they are looking at.I just can't get anyone to return my calls.They were returning my calls until we got to the part about them saying I probably was responsible for his bills,then she just said well,call me back in three or four days,I need to talk to my supervisor,after that,they won't return calls.Don't know,makes me nuts sometimes :lol: ...Karen
