possible letter to one click cash
Date: Tue, 06/27/2006 - 20:37
Here's the letter I'm considering having my husband send to One Click Cash. With modifictions, we'll send it to United Cash Loans and ameriloan too. Do you all think we should ask them to just zero out our loans, or should we ask them for a refund? I'd love to get refunds, but I'd hate to make them mad and unwilling to work with us at all...
And what do you guys think about Sonic Payday? I'd love to recoup some of the money I've paid them, but it sounds like they can be difficult. Would this letter (with appropriate modifications...) work?
Thoughts? Suggestions? Thanks!!!

One Click Cash 2533 N Carson St, Ste 5024 Carson City, NV 89706 Fax 800-803-9136 Regarding: Loan ID xxx xxxx To Whom It May Concern: This letter is to inform you that any further payments to One Click Cash will not be honored by my banking institution. According to Colorado state statutes, One Click Cash does not have authority to do business in Colorado. Payday loan companies who operate in Colorado (even via the internet) are required to be licensed by the state attorney general's office. Your company is not. The state attorney general of Colorado recently sued Quik Payday, Inc., of Logan, Utah, for making illegal “payday†loans via the Internet in violation of Colorado law. The suit was settled for $2 million dollars. In addition, according to Colorado state statutes, payday lenders can only roll over loans just once. After that, the loan must be paid in full. My loan with One Click Cash has been rolled over multiple times. Lastly, Colorado state statutes allow for a finance charge for each deferred deposit loan that may not exceed twenty percent of the first three hundred dollars loaned. My current loan with One Click Cash is for $300. One Click Cash has charged my account $90 every two weeks, which is more than the $60 allowed by Colorado state statutes. I reside in Colorado, and have for the entire course of the loans I've received from you. My instinct is to charge One Click Cash for the finance charges incurred over the course of my loans. However, I am willing to forgo the money I feel I am owed if One Click Cash ceases to charge my bank account and is willing to zero out my current loan. If One Click Cash is unwilling to settle this matter in this way, I will be happy to register a formal complaint with my attorney general's office. Sincerely, Darren Russell |

I think the letter sounds good---but when posting in a public forum like this I would edit and remove your name and loan ID number. I would also ask them to reply to your letter within so many days. Good luck.
I removed the loan number. That was silly of me. Thanks!

The letter sounds good and represents the statutes of your state. If possible, mention the usury codes of your state giving it the most legal importance. After reviewing your letter, One Click Cash will be bound to make a positive decision for you if they have been unfair in the past. Hope everything ends well for you!!
Can't believe this is legal!!
I understand your frustrations! I am in Ohio and am fighting several...Ameriloan included. This is rediculous. I have had a total of $3155 deducted from my chking acct after 5 different loans should've been paid off.
Any info would be great help! My bank is looking into it for me...I have a small child and cannot afford this!

Jeez! $3155 is a big amount. You need to take the help of a lawyer specializing in the lawsuits of fdcpa and FCRA violations. Keep the documents of dispute done by your bank with the company. They will be required in the later stage. If they are unable to verify the debits, money must be reverted back to your account.
