Question regarding credit union loan

co-worker...she and her husband have an unsecured
loan through their credit union and have recently
enrolled in a debt consolidation program. The
credit union knows this but is telling her that
they can still take them to court for non-payment. Can they do this?

It is up to the credit unions if they intend to take the matter to the court. If the case if not for a huge amount, they will like to settle the matter outside the court as there are court costs and attorney fees involved in it. If you can prove your payments towards the debt account, the judge might not take decisions against you. A payment plan will be set for you through the court.
Talk to your debt consolidation company and verify the payments sent towards the account. Keep receipts of the payments in safe place as this is your important proof.

You are welcome, Missy :) I am sure your companies will step back in filing a case against you if you are regular with your payments. As you have hired a consolidation company, they will try to keep everything in place.
