I forgot to mention in my previous post, the loan company threatening is with legal action is United Cash Loans. They put all 3 loans we had with their other companies-Ameriloan, One Click Cash, and United-into one big balance. The loans are from last year and like I said, the bank acct has long since been closed. does anyone have any experience with them and what they do for legal action? and again, I'm in Florida. I dont know if they can have us arrested or just try to sue us

They are all affliated, but they can't combine all into one. United Cash Loans won't take any legal action. It is a common threat among the online pdl industry. They won't even try to sue. United Cash Loans isn't licensed in any state, they are being investigated in some states for their activity. Next time they call, stand firm and don't let them smell fear. They thrive on that.

Jeannie---What state are you in? If you read the posts some people have had luck with a letter sent to United Cash requesting refunds or marking account paid in full (if UCL is operating illegally in your state)But according to Tammy's post above they aren't licensed in any state so you might have a chance. Check out the posts and pollyandsay's blog for letter ideas.

I missed your first post but you can check with the office of the attorney general in Florida for more information regarding payday loan laws in your state. There is also a thread on the forum that lists different payday loan laws for different states. Have these loans been placed with a collection agency? I'm sorry but I missed your other post.

Jeannie..I'm in florida, and they absolutely CAN not sue you here, as they are illegal in this state!
Call the Florida of Business and Professional Regulation Department of Financial Affairs in your area, or the one in Tallahasee, and tell them what's going on.
They will try to help you. They've helped me immensely.
These guys won't come here to sue you, if they try it, they will be laughed out of court. They have no business conducting any kind of transactions in this state....
So write those clowns a nice long letter, and tell them to bite ya!~
