The rule is that the creditor must have a legal judgment against you before any actions are taken. He can visit someone else who owes you money or has your money and do the interception through your bank account. That person who owes you the money is called garnishee defendant and he can be forced to reveal to the court how much money is owed. These actions vary as per the state laws. Bank Account Taken
A creditor 10 years ago put a judgement on me and my Ex. I divorced him in 92 and this is from 1998. They can't find him so they have come after me.
Question is If the Texas laws state no wage garnishment, than how did they take my social security and retirement check. That's my wages that are a direct deposit. What is the difference of garnishments or taking it out of my bank account. That's the only way I have of paying my bills. This is not right.
The lawyer can't even tell me who put the judgement on me. He's bought the debt or what ever they do from another collection agency so he has no details of the whole thing. He found my bank account number and took my social security and retirement check.
So the law seems to be not standing up in the state of Texas that a creditor can get your wages.

You can give court a bond in the amount that could satisfy the debt if you lose. But then they know you have a asset. You end up and the lawyer several thousand anyway and probably lose. Try cash your check buy money orders. Stop all those direct deposits. If you could a bank they will take it.

They cannot seize social security, student aid, child support, or alimony. It's best to have those accounts separate so they can't argue commingled funds.
