Can I not pay credit card bills?

I know first off everyone says NO WAY but please read. I have a few low balance cards and at this financial point it is feed the kids and keep a roof over our heads or pay the credit card sharks. Most of the accounts a only in my name and NC doesn't do joint property for husband and wife. The also don't do wage garnishments. I talk to a bankruptcy lawyer and he said just don't pay, the worst is they take me to court (I don't have to go) and they get a judgement where I would have to fill out a emxept property form and they couldn't take anything I own since the house is the only joint property and we just bought it so no equity and state law won't allow it anyways. Here is what I owe, Bank of America $4000, Capital one 600, providian 1000. My idea is to default ruin my credit (which it already is due to some medical bills) and maybe negoiate and pay a lower amount once the collection agency gets it. I don't have a home phone or work phone (since I don't work) and they don't have my physical address. I can handle the letters the send emotionally. Has anyone done this before or have any advise? By the way Bank of America is charging 32% interest!!!!!!!!!!!

When did you last pay towards these accounts? You can apply the SOL factor in order to escape these debts legally. Check the statute of limitations in your state as well as the date of last payment done towards the accounts. See if the state law regarding statutes is applicable or not.

On the other hand, if you want to pay the debts through easy monthly installments, try a consolidation program. This program will help you in improving your credit. You will be able to pay your utilities and save some money after paying through the consolidation plan.

I recieved a letter from you people concerning three bills, that you are saying that I have. I have not had account with Speigel for over twenty years,( I thought Speigel's went out of business years ago),nor Eddie Bauer( never heard of them) or Newport News.I do not know anything about these charges.

I just found out that there is a person that has using my name expect her name is Joyce K Brown and she is on my credit report.
The reason I know this is when my purse was stolen is when I found this person was useing my social security number, it has been reported. I had a fraud alert on my social security number.
In 2000 filed Bankruptcy( chapter 7) and all my debit were wet out. The bankruptcy was closed out in 2001.
